Prescribed Public Sector Entities

Municipalities, local boards and municipal services corporations

1. (1) Each municipality, each local board and each municipal services corporation is prescribed for the purposes of clause (c) of the definition of “public sector entity” in section 1 of the Act, except,

(a) in its capacity as a generator within the meaning of the Electricity Act, 1998 that is authorized, under subsection 144 (2) of that Act, to generate electricity by means other than through a corporation incorporated under the Business Corporations Act; and

(b) in relation to a long-term care home or any work done to prepare a site to be used as a long-term care home, including any construction or renovation work.

(2) In subsection (1),

“local board” means a local board as defined in subsection 1 (1) of the Municipal Act, 2001 or as defined in subsection 3 (1) of the City of Toronto Act, 2006; (“conseil local”)

“long-term care home” has the same meaning as in the Fixing Long-Term Care Act, 2021; (“foyer de soins de longue durée”)

“municipal services corporation” means a corporation that satisfies both of the following criteria:

1. The corporation is,

i. a corporation established by a municipality under section 203 of the Municipal Act, 2001,

ii. a secondary corporation as defined in subsection 203 (3.1) of the Municipal Act, 2001,

iii. a corporation established by the City of Toronto under section 148 of the City of Toronto Act, 2006, or

iv. a secondary corporation as defined in subsection 148 (4) of the City of Toronto Act, 2006.

2. The corporation’s shares are all owned by,

i. one or more municipalities, or

ii. one or more municipalities and the Crown in right of Ontario. (“société de services municipaux”)

Commencement

2. This Regulation comes into force on the later of March 30, 2026 and the day this Regulation is filed.
