Amending O. Reg. 745/21
(GENERAL)
1. (1) Section 25 of Ontario Regulation 745/21 is amended by striking out the portion before paragraph 1 and substituting the following:
25. For the purposes of clause 39 (1) (d) of the Act, liquor may be imported into Ontario in the following circumstances:
. . . . .
(2) Paragraph 5 of section 25 of the Regulation is revoked and the following substituted:
5. The liquor is beer and is imported into Ontario from another province or territory of Canada by a manufacturer of beer licensed under the Act for the purpose of selling the beer to purchasers in Ontario in accordance with the terms of an authorization from the LCBO.
(3) Section 25 of the Regulation is amended by adding the following paragraph:
9. The liquor is imported into Ontario by the holder of a grocery store licence or a convenience store licence after having been purchased legally by the licensee in Ontario and subsequently held temporarily in a warehouse or distribution centre in a province or territory of Canada that shares a land border with Ontario.
2. The Regulation is amended by adding the following section:
Licence conditions re importation, para. 9 of s. 25
25.1 It is a condition of every grocery store licence and every convenience store licence that, if the licensee imports liquor as described in paragraph 9 of section 25, the licensee,
(a) maintain records of the purchase of the liquor, the location of the warehouse or distribution centre in the other province or territory, the date the liquor was shipped to the warehouse or distribution centre in the other province or territory and the date of its importation back into Ontario; and
(b) distribute the liquor to either,
(i) a grocery store or convenience store in respect of which it holds a grocery store licence or a convenience store licence, or
(ii) a distribution centre or warehouse at which it holds products for distribution to a grocery store or convenience store described in subclause (i).

3. This Regulation comes into force on the later of July 1, 2026 and the day this Regulation is filed.
