Amending O. Reg. 148/24

(ENTITIES NOT PERMITTED TO HOLD CERTAIN PROPERTY AND INTERESTS (SECTION 11.0.1 OF THE ACT))

1. The definition of “prescribed entity” in section 1 of Ontario Regulation 148/24 is amended by adding “or 2.1” at the end.

2. Section 2 of the Regulation is amended by adding the following paragraphs:

1.1 Centralized Supply Chain Ontario.

3. The Regulation is amended by adding the following section:

Prescribed entities, office space

2.1 (1) Section 11.0.1 of the Act applies with respect to the following entities only in respect of office space, including office space identified in this section:

1. Building Ontario Fund.

2. iGaming Ontario.

3. Liquor Control Board of Ontario.

4. Metrolinx.

5. Ontario Cannabis Retail Corporation.

6. Ontario Clean Water Agency.

7. Ontario Lottery and Gaming Corporation.

8. Owen Sound Transportation Company Limited.

9. Venture Ontario.

(2) The following properties held by the Liquor Control Board of Ontario are office space for the purposes of subsection (1):

1. 180 Shearson Crescent, Unit 9, Cambridge.

2. 1020 Bayridge Drive, Unit 2, Kingston.

3. 1100 Dearness Drive, Unit 11/12, London.

4. 245 Menten Place, Unit 200, Nepean.

5. 17 Colborne Street, Unit 106, Orillia.

6. 150 Churchill Boulevard, Unit C018, Sault Ste. Marie.

7. 2040 Algonquin Road, Unit 16, Sudbury.

8. 2901 Bayview Avenue, Unit C105, Toronto.

9. 100 Queens Quay East, Floors 4 to 12, Toronto.

10. 1615 Dundas Street East, Unit 302, Whitby.

(3) The following properties held by Metrolinx are office space for the purposes of subsection (1):

1. 10 Bay Street, Floors 13 to 17, Toronto.

2. 20 Bay Street, Floors 2, 5 to 10, 12 to 14, 16, 19 and 20, Toronto.

(4) The following properties held by Metrolinx are deemed not to be office space for the purposes of subsection (1):

1. 97 Front Street West, Toronto.

2. 277 Front Street West, Toronto.

(5) The following property held by the Ontario Cannabis Retail Corporation is office space for the purposes of subsection (1):

1. 4100 Yonge Street, Floor 2, Toronto.

(6) The following properties held by the Ontario Clean Water Agency are office space for the purposes of subsection (1):

(7) The following property held by the Ontario Lottery and Gaming Corporation is office space for the purposes of subsection (1):

1. 4120 Yonge Street, Floors 4 to 6, Toronto.

(8) The following property held by the Ontario Lottery and Gaming Corporation is deemed not to be office space for the purposes of subsection (1):

1. 70 Foster Drive, Sault Ste. Marie.

(9) The following properties held by the Owen Sound Transportation Company Limited are office space for the purposes of subsection (1):

1. 1415 1st Avenue West, Owen Sound.

2. 717875 Highway 6 (Road 5), Owen Sound.

4. Section 6 of the Regulation is revoked and the following substituted:

Exceptions re investments

6. Subsections 11.0.1 (2) and (3) of the Act do not prevent or restrict the following entities from holding, controlling or making financial investments:

1. Building Ontario Fund.

2. Ontario Financing Authority.

3. Venture Ontario.

Commencement

5. This Regulation comes into force on the later of April 1, 2026 and the day this Regulation is filed.
