Amending O. Reg. 87/24

(TRAINING)

1. Sections 6 and 7 of Ontario Regulation 87/24 are revoked and the following substituted:

Mental health crisis response, initial training

6. (1) Every police officer shall, before the deadline described in subsection (2) or (3), as applicable, successfully complete the program entitled “Mental Health Crisis Response (MHCR) Education and Applied Training” delivered by one of the following:

1.  Wilfrid Laurier University.

2.  An individual who has,

i.  successfully completed the course entitled “MHCR Train-the-Trainer (MHCR-T3)”, delivered by Wilfrid Laurier University, and

ii.  been certified by Wilfrid Laurier University to deliver the program.

(2) Subject to subsection (3), the deadline mentioned in subsection (1) is,

(a)  October 1, 2026, if the police officer’s assigned responsibilities include performing community patrol functions or providing community patrol supervision; or

(b)  October 1, 2027, in any other case.

(3) If a police officer is assigned the responsibility of performing community patrol functions or providing community patrol supervision on or after October 1, 2026 but before October 1, 2027, the program described in subsection (1) must be completed before the earlier of,

(a)  the day that is 60 days after the day those responsibilities are assigned; or

(b)  October 1, 2027.

(4) This section does not apply to a police officer who satisfies either of the following criteria:

1.  The police officer was appointed as a police officer on or after the transition date.

2.  The police officer has successfully completed the program entitled “Basic Constable Training Program”, delivered by the College, after June 1, 2023.

Mental health crisis response, ongoing training

7. (1) Every police officer shall, before the applicable deadlines described in this section, successfully complete the course entitled “MHCR In-Service Officer Requalification Requirements” delivered by Wilfrid Laurier University or by an individual described in paragraph 2 of subsection 6 (1).

(2) The course described in subsection (1) must be successfully completed,

(a)  before the first deadline described in subsection (3) or (4), as applicable; and

(b)  within every subsequent 12 months after that first deadline.

(3) The first deadline for a police officer whose assigned responsibilities include performing community patrol functions or providing community patrol supervision is the latest of,

(a)  October 1, 2027;

(b)  the date that is 12 months after the date the police officer was appointed; and

(c)  if section 6 applies to the police officer, the date that is 12 months after the date the officer successfully completes the program mentioned in subsection 6 (1).

(4) The first deadline for a police officer whose assigned responsibilities do not include performing community patrol functions or providing community patrol supervision is the later of,

(a)  October 1, 2028; and

(b)  the date that is 12 months after the date the police officer was appointed.

(5) Despite subsections (2) to (4), the chief of police of a police officer may extend a deadline for completing the training required by this section by up to 60 days if the chief of police determines that it is not reasonably possible for the police officer to comply with the deadline.

2. This Regulation comes into force on the day it is filed.
