(CONSTRUCTION PROJECTS)
1. (1) Subsection 22 (2) of Ontario Regulation 213/91 is amended by striking out “and” at the end of clause (a), by adding “and” at the end of clause (b) and by adding the following clause:
(c) satisfies the requirements set out in,
(i) subsection (3), if the worker may be exposed to side impact hazards when on the project, or
(ii) subsection (4), if subclause (i) does not apply.
(2) Section 22 of the Regulation is amended by adding the following subsections:
(3) For the purposes of subclause (2) (c) (i), the protective headwear shall satisfy one of the following requirements:
1. It shall be manufactured in accordance with and meet the design, performance and test requirements of Type 2 protective headwear in the CSA Standard Z94.1, Industrial protective headwear — Performance, selection, care and use or Type II protective headwear in the ANSI Z89.1 Standard, American National Standard for Industrial Head Protection.
2. It shall provide protection that is at least equal to that provided by protective headwear that meets the requirement set out in paragraph 1.
(4) For the purposes of subclause (2) (c) (ii), the protective headwear shall satisfy one of the following requirements:
1. It shall be manufactured in accordance with and meet the design, performance and test requirements of protective headwear in the CSA Standard Z94.1, Industrial protective headwear — Performance, selection, care and use or the ANSI Z89.1 Standard, American National Standard for Industrial Head Protection.
2. It shall provide protection that is at least equal to that provided by protective headwear that meets the requirement set out in paragraph 1.
(5) If the conditions on a project may cause protective headwear worn by a worker to dislodge, a chin strap or other retention system shall be used to prevent dislodgement.

2. This Regulation comes into force on July 1, 2027.
