Amending O. Reg. 668/98
(WILDLIFE IN CAPTIVITY)
1. Subsection 5 (3) of Ontario Regulation 668/98 is amended by striking out “Copies of” at the beginning.
2. Subsection 8 (3) of the Regulation is revoked and the following substituted:
(3) The log book shall be kept for five years from the date the log book was required to be kept under subsection (1).
3. Section 9 of the Regulation is amended by striking out “clause 40 (2) (a) or (b) of the Act” and substituting “paragraph 1 or 2 of subsection 40 (2) of the Act”.
4. Section 10 of the Regulation is amended by adding the following definition:
“licence summary” means licence summary as defined in subsection 1 (1) of Ontario Regulation 665/98 (Hunting) made under the Act; (“sommaire de permis”)
5. Section 11 of the Regulation is amended by adding the following subsections:
(2) An apprentice falconry licence shall consist of,
(a) a licence summary issued or updated to identify the apprentice falconry licence; or
(b) a licence issued in the format established by the Minister.
(3) A general falconry licence shall consist of,
(a) a licence summary issued or updated to identify the general falconry licence; or
(b) a licence issued in the format established by the Minister.
(4) A commercial falconry licence shall be issued in the format established by the Minister.
6. (1) The English version of paragraph 1 of subsection 12 (2) of the Regulation is amended by striking out “he or she” and substituting “they”.
(2) Paragraph 3 of subsection 12 (2) of the Regulation is amended by striking out “issued under this Regulation at any time in the five-year period prior to the date of applying for the licence” at the end and substituting “issued under the Act”.
7. (1) Paragraph 2 of subsection 13 (1) of the Regulation is amended by striking out “under this Regulation” and substituting “under the Act”.
(2) The English version of paragraph 3 of subsection 13 (1) of the Regulation is amended by striking out “he or she has kept” and substituting “they have kept”.
(3) Paragraph 4 of subsection 13 (1) of the Regulation is amended by striking out “under this Regulation” and substituting “under the Act”.
8. The English version of subsection 14 (2) of the Regulation is amended by striking out “his or her” and substituting “their”.
9. The English version of section 21 of the Regulation is amended by striking out “his or her” and substituting “their”.
10. (1) Paragraph 5 of subsection 25 (2) of the Regulation is amended by striking out “specially protected raptors” and substituting “a specially protected raptor”.
(2) Paragraph 8 of subsection 25 (2) of the Regulation is revoked and the following substituted:
8. The person shall carry their general falconry licence, commercial falconry licence or apprentice falconry licence on their person while hunting or trapping a specially protected raptor under subsection (1).
11. The Regulation is amended by adding the following section:
26.1 (1) The holder of a general falconry licence or an apprentice falconry licence shall submit an annual report to the Minister in the format established by the Minister no later than December 31 of the year in which the licence was held.
(2) The holder of a commercial falconry licence shall submit an annual report to the Minister in the format established by the Minister no later than January 31 following the year in which the licence was held.
(3) If the holder of a general falconry licence, apprentice falconry licence or commercial falconry licence kept a specially protected raptor in captivity in the year in which they held the licence, the report referred to in subsection (1) or (2), as the case may be, shall include information on the raptor kept by them as well as any other information specified by the Minister.
(4) Any other person who kept a specially protected raptor in captivity shall submit an annual report to the Minister in the format established by the Minister containing information on the specially protected raptor kept by the person and any other information specified by the Minister no later than January 31 following the year in which the raptor was kept.
12. (1) Subsection 27 (1) of the Regulation is amended by striking out the portion before clause (a) and substituting the following:
(1) A person who keeps a specially protected raptor or non-indigenous falconry bird in captivity shall keep a log book in the format established by the Minister that includes the following information respecting the bird,

(2) Subsections 27 (4) and (5) of the Regulation are revoked and the following substituted:
(5) A person who keeps a specially protected raptor in captivity shall keep the log book for five years from the date of expiry of the licence or authorization that was valid at the time the raptor was kept.
(5.1) A person who keeps only a non-indigenous falconry bird in captivity shall keep the log book for five years from the date the log book was last required to be updated under subsection (2).
13. The English version of section 34 of the Regulation is amended by striking out “his or her” and substituting “the Minister’s”.
14. The English version of subsection 43 (4) of the Regulation is revoked and the following substituted:
(4) A person wishing to use a train and trial area shall ensure that their name and the other information required under this section is entered in the register before they release a dog in the train and trial area or in any way use the area.
Commencement
15. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of July 1, 2026 and the day this Regulation is filed.
(2) Sections 11 and 12 come into force on the later of January 1, 2027 and the day this Regulation is filed.
