Notification of the Chief Building Official
Definition
1. In this Regulation,
“business day” means Monday to Friday, excluding holidays.
Fees
2. (1) For the purposes of subsection 40 (3) of the Act, the Corporation shall pay the fees set out in any by-law made under subclause 7 (1) (c) (i) of the Building Code Act, 1992.
(2) Any by-laws made under clause 7 (1) (c.1) or (d) of the Building Code Act, 1992 apply in respect of a payment made under subsection (1) of this section.
Assessment, exception
3. The provisions listed in the definition of “applicable law” in Sentence 1.4.1.3 (1) of Division A of the building code, as defined in the Building Code Act, 1992, are prescribed for the purposes of clause 40 (4) (d) of the Act.
Report format
4. The form titled “Building Code Compliance Report”, dated July 17, 2026 and available on a Government of Ontario website is prescribed for the purposes of subsection 40 (5) of the Act.
Report deadline
5. For the purposes of subsection 40 (3) of the Act, the prescribed period is the period ending 30 business days after the chief building official receives a notice under subsection 40 (1) of the Act.
Inspection deadline
6. (1) For the purposes of subsection 40 (7) of the Act, the prescribed period is the period ending 10 business days after the chief building official or the registered code agency, as applicable, receives a notice under subsection 40 (6) of the Act.
(2) Despite subsection (1), the Corporation and the inspector or registered code agency, as applicable, may agree in writing to extend the period referred to in that subsection.
Occupancy opinion deadline
7. (1) For the purposes of subsection 40 (9) of the Act, the prescribed period is the period ending 10 business days after the chief building official or the registered code agency, as applicable, receives a notice under that subsection.
(2) Despite subsection (1), the Corporation and the chief building official or the registered code agency, as applicable, may agree in writing to extend the period referred to in that subsection.
Commencement
8. This Regulation comes into force on the day it is filed.
