Amending O. Reg. 610/98

(THE IESO)

1. (1) Paragraph 1 of subsection 1 (1) of Ontario Regulation 610/98 is amended by adding “subject to subsection (2.1)” at the end.

(2) Section 1 of the Regulation is amended by adding the following subsections:

(2.1) For the purposes of paragraph 1 of subsection (1), clauses (2) (a) to (f) do not include,

(a) a board as defined in subsection 1 (1) of the Education Act;

(b) a post-secondary institution that is,

(i) a publicly-assisted university within the meaning of the Ministry of Training, Colleges and Universities Act,

(ii) a college established under the Ontario Colleges of Applied Arts and Technology Act, 2002, or

(iii) an Indigenous Institute prescribed under section 6 of the Indigenous Institutes Act, 2017;

(c) a hospital within the meaning of the Public Hospitals Act;

(d) a non-profit long-term care home within the meaning of the Fixing Long-Term Care Act, 2021; or

(e) a government organization within the meaning of subsection (2.2), unless its primary activity requires licensure under Part V of the Ontario Energy Board Act, 1998 as a generator, distributor, transmitter, retailer or owner or operator of an electricity storage facility, or authorization by the market rules as a market participant.

(2.2) For the purposes of clause (2.1) (e), a government organization is,

(a) an entity for which the Lieutenant Governor in Council, the Governor in Council or a minister of the Government of Ontario or of Canada may appoint at least one member of its board of directors or other governing body;

(b) any person or entity whose primary function is to operate or manage assets owned by or held for the benefit of an entity referred to in clause (a); or

(c) a municipality, a municipal services corporation as defined in subsection 144 (3) of the Act or a local board as defined in the Municipal Affairs Act.

Commencement

2. This Regulation comes into force on the day it is filed.
