Particulars of a Revocation of Registration

s. 49 (1) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the withdrawal of the appeal of 1294550 Ontario Inc. o/a Clarkridge Career Institute to require a hearing of the Licence Appeal Tribunal under s.19 (3) of the Ontario Career Colleges Act, 2005 (“the Act”). On July 11, 2023, the Superintendent issued a Notice of Proposal to Revoke Registration to Clarkridge Career Institute. Clarkridge Career Institute filed a notice of appeal to the Licence Appeal Tribunal on July 21, 2023. The appeal was withdrawn on January 12, 2024. The proposal to revoke Clarkridge Career Institute’s registration was therefore carried out on January 12, 2024, pursuant to s. 19 (4) of the Act.

Reasons for decision

The Superintendent has revoked Clarkridge Career Institute’s registration for the following reasons:

  1. Private Career Colleges Act,2005, s. 18 (2) (c), – the registrant has failed to comply with a provision of this Act or the regulations – Substantial changes to vocational programs
    • The Registrant failed to deliver the vocational program as approved by making substantial changes as provided in O. Reg 315/06, s. 13 (1) Substantial change to vocational program:
      • A change in the program that would result in a change in the degree of knowledge or specialization with respect to the vocation.
      • A change in the duration of the program.
      • A change in the mode of delivering the program.

        Thereby contravening s. 23 (6) of the Private Career Colleges Act, 2005.
  2. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with provision of the Act or Regulations – Student files Content
    • Student files provided by the Registrant failed to include each item prescribed by s. 45 (1) 5 of O. Reg. 415/06, thereby contravening s. 45 (1) of O. Reg. 415/06.
  3. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with a provision of the Act or Regulations – Qualifications of instructional staff,
    • The Registrant employed persons who did not meet the prescribed minimum experience requirements and were not qualified to provide instruction in the vocational program, thereby contravening O.Reg. 415/06, s. 41 (1) (b).
  4. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with a provision of the Act or Regulations – Personal information re: instructors
    • The Registrant failed to keep a complete record of personal information as prescribed by O. Reg 415/06, s. 42 (1) for all instructors at the campus of the college at which the person is employed, thereby contravening O. Reg 415/06, s. 42 (2).
  5. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with a provision of the Act or Regulations – Notice of other changes
    • The Registrant operated a campus in Timmins without notifying the Superintendent of a change or addition to the campus location, thereby contravening O. Reg 415/06, s. 48 (1).
  6. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with provision of the Act or Regulations – Obstruction
    • During the inquiries of a designate of the Superintendent pursuant to s. 38 of the Private Career Colleges Act, 2005, the Registrant provided false and misleading information and documentation relating to the provision of vocational programs
    • Some of the Registrant’s instructors provided false and misleading information to designates during interviews conducted pursuant to s. 38 of the Private Career Colleges Act, 2005
    • The Registrant’s scheduling and attendance tracking methods, as utilized by all instructors in the two vocational programs reviewed, recorded the provision of training hours which were not actually delivered to students, thereby providing misleading information to designates and contravening s. 38 (10) of the Private Career Colleges Act, 2005
    • The Registrant purports the delivery of classes and portions of a vocational program to a group of persons where evidence demonstrates that said classes and delivery of portions of the vocational program did not occur, thereby providing false and misleading information to designates and contravening s.38 (10) of the Private Career Colleges Act, 2005.
  7. Private Career Colleges Act, 2005, s. 18 (2) (a), Requirement of subsection 14 (1) no longer met – Honesty and Integrity
    • The Superintendent of Private Career Colleges is no longer satisfied that:
      • that it is in the public interest as required pursuant to subsection 14a of the Act read together with O. Reg. 415/06 s. 4.3 (whether vocational programs would jeopardize public health and safety)
      • that the applicant will operate the private career college in compliance with the Act and the regulations
      • that the past conduct of the applicant provides grounds for the belief that the private career college will be operated in accordance with the law and with integrity and honesty
      • that the applicant is not carrying on activities that are, or will be, if the applicant is registered, in contravention of the Act or regulations

On January 12, 2024, the Superintendent carried out the proposal to revoke the registration of Clarkridge Career Institute.
