In Bulletin No. 74078 Land Registrars were advised not to accept registered duplicates for re-registration without referring them to the Property Law Branch.

Notwithstanding Bulletin No. 74078 Land Registrars may accept a duplicate deed or mortgage for registration (without reference to this office) where it is being registered to provide evidence of Planning Act consent, and the only difference between the original. and the duplicate is the addition of the consent.

When the Land Registrar accepts a registered duplicate for re-registration, he should ensure that the registration requirements (such as affidavits of Land Transfer Tax, Land Speculation Tax, etc.) which currently apply for the registration of original instruments are complied with.
