Legislation: Commissioners for Taking Affidavits Act

Section 6 of the Commissioners for Taking Affidavits Act, R.S.O. 1980, chapter 75 reads as follows:

  • 6. Every commissioner whose commission is limited in its duration or as to territory or purpose shall indicate the limitation by means of a stamp approved by the Inspection of the Legal Offices affixed under his signature.

The wording on the stamp must include:

  1. the name of the commissioner in full;
  2. the limitation as to territory, e.g. county, distrct or region;
  3. the limitation as to purpose, e.g. legal firm; and
  4. the expiry date.

Please note that all of the above information must be included in the approved stamp, and it is not permissible to add or change the expiry date or any other portion of the required wording in writing, printing, typing or by any other means.

Effective April 2, 1984, Land Regisrars should not accept an affidavit, declaration or affirmation where a commissioner’s stamp does not comply with the above requirements.
