Ontario Regulation 422/86 made under the Land Registration Reform Act, 1984 was filed with the Registrar of Regulations on July 18, 1986. It comes into force on August 18, 1986.
The Regulation adds bilingual forms of Transfer/Deed, Charge/Mortgage, Discharge of Charge/Mortgage, Document General and Schedule to the English only and French only versions of those forms that are presently authorized for registration under the Land Titles Act and the Registry Act in five Land Registry offices (namely Prescott, Russell, Glengarry, Sudbury and Timiskaming).
The Regulation also removes the instructions that are presently found on the back of the English only and French only forms. However, the old forms containing those instructions will not be refused for registration provided they are acceptable in all other respects. For instructions on the forms, users should refer to the Land Titles Procedural Guide and the Document User Guide.
The bilingual form of Transfer/Deed does not include boxes 13 and 14, being the optional statements under the Planning Act, 1983. However, a Transfer/Deed with a Schedule attached that contains a bilingual version of Boxes 13 and 14 is acceptable for registration, provided the Schedule contains wording identical to boxes 13 and 14 on both the English only and French only prescribed Transfer/Deed.
All forms prescribed by the Regulations, as well as an acceptable Schedule containing a bilingual version of boxes 13 and 14 from the prescribing Transfer/Deed, are available from legal stationers. For reference, copies of the new bilingual forms and an acceptable bilingual Schedule containing Boxes 13 and 14 of the Transfer/Deed are attached to this Bulletin.
