Contents of the memo:

It has recently come to my attention that plans are being submitted for deposit and registration where the title includes information that does not relate to the legal description of the lands included on the plan.

The intent of the plan title is to provide the geographic location as set out in s. 24, O.Reg. 42/96 under the Surveyors Act. The title will include:

  1. the lot, block, reserve, unit, street, etc.;
  2. the concession, plan or level;
  3. the name of the geographic township (if applicable) and,
  4. the name of the municipality, county, district or regional municipality.

Any plan that has a title that includes extraneous information (e.g. such as the name of the development – ‘Homewood Acres’) that does not relate to the legal description of the property will not be acceptable for deposit or registration. Such information may be included on the perimeter of the plan in a manner that does not interfere with the illustration of the subject lands or any other required information or Forms.
