Contents of the memo:

Recently, our Ministry has been contacted by the Ministry of the Environment concerning the above noted transfers. Despite memo EM199712 advising that these transfers would end in 1999, they will continue to be presented for registration. In light of this, we have granted authorization for these documents to be registered in paper form in all land Registry Offices.

We have approved new document generals (Land Titles and Registry) that have an additional paragraph to the two set out in memo EM199712, Therefore, the Ministry of the Environment will now be completing their documents using one of the three approved paragraphs. Please use the attached document generals in conjunction with the ones in memo EM199712.

In addition, Regulation 374/04 under the Land Transfer Tax Act exempts acquisition of land by municipalities, pursuant to transfer orders under the Municipal Water and Sewage Transfer Act, from land transfer tax. Therefore, a land transfer tax affidavit is not required to be included with the transfer order, However, if a municipality has attached a completed affidavit, the document should not be refused registration.

This memo is to be used in conjunction with memo EM199712.
