Order content:

Pursuant to section 163.1, of the Land Titles Act and subsection 101.1 (1) of the Registry Act (the "Acts"), I Harinder S. Takhar, Minister of Government Services hereby order that the fees described as Statutory Fees set out in the Schedules hereunder shall be payable.

The fees described as ELRSA Fees are fees required to be specified in an order under Section 2(4) of the ELRSA, 2010.

This Order comes into effect December 16th, 2010.

Part I

  1. In this order:
    • "remote" when used in reference to services set out in this Order means the service is not
      obtained at a land registry office, save for those services obtained at a land registry office from a
      selfservice kiosk that requires a license as described in Schedule III.
    • "Key" when used in reference to a Land Registry Office ("LRO") or Writs Enforcement Office
      ("EO") means the default LRO or EO associated with a license described in Schedule III to this Order.
  2. The following fees are payable from the effective date of this Order and to and including November 1, 2015.

Part II

  1. In this Part II:
    • "Actual Fee" means, for a specified year, the fee Statutory Fee or ELRSA Fee that is
      payable on the Annual Effective Date in the specified year;
    • "Annual Effective Date" means the first Monday in November; and
    • "Consumer Price Index" means the Consumer Price Index for Canada, all-items, not seasonally
      adjusted (2002=100), as published by Statistics Canada in Table 5 of The Consumer Price
      Index (Catalogue no. 62-001-X).
  2. On November 2, 2015 the following fees set out in Schedule 1 are amended as follows:

  3. The amended fees for Items 8 and 10 of Schedule 1 set out in Section (2) above shall be used as the value for A for the purposes of the formula contained in Section (4)(a) instead of the Actual Fee payable for 2014.
  4. For the purposes of all of the services in Schedule I of this Order, the following is the fee
    payable on and after November 2,2015:
    1. The fee payable on and after November 2, 2015 and before the Annual Effective Date in 2016 is the amount determined in accordance with the following rules:
      1. Calculate the notional fee for 2015 using the formula,
        (A x B x 0.5) + A
        in which,
        • "A" is the Actual Fee payable for 2014, and
        • "B" is the indexation factor for 2015, as determined in accordance with Subsection (4)(c), and
      2. Choose the amount that is the higher of the notional fee for 2015 and the Actual Fee for 2014.
      3. The amount chosen, as rounded to the nearest multiple of five cents, is the fee payable on and after November 2, 2015 and before the Annual Effective Date in 2016.
    2. The amount of the fee payable on and after the Annual Effective Date in a specified year after 2015 and before the Annual Effective Date in the following year is the amount determined in accordance with the following rules:
      1. Calculate the notional fee for the year using the formula,
        (C x D x 0.5) + C
        in which
        • "C" is the notional fee for the preceding year, and
        • "D" is the indexation factor for the specified year, as determined in accordance with Subsection (4)(d).
      2. Choose the amount that is the higher of the notional fee for the year and the Actual Fee for the preceding year.
      3. The amount chosen, as rounded to the nearest multiple of five cents, is the amount of the fee payable on and after the Annual Effective Date in the specified year and before the Annual Effective Date in the following year.
    3. The indexation factor for 2015 is the percentage calculated using the formula,
      [(l+E) x (1 +F) x (l+G) x (l+H) x (1+ J)] 1
      in which,
      • "E" is the CPI percentage change for June 2011, from the corresponding month of the previous year,
      • "F" is the CPI percentage change for June 2012, from the corresponding month of the previous year,
      • "G" is the CPI percentage change for June 2013, from the corresponding month of the previous year,
      • "H" is the CPI percentage change for June 2014, from the corresponding month of the previous year, and
      • "J" is the CPI percentage change for June 2015, from the corresponding month of the previous year.
    4. The indexation factor for a specified year after 2015 is the CPI percentage change, for June of the specified year, from the corresponding month of the previous year.
  5. A reference in Subsection (4)(c) or Subsection (4)(d) to the CPI percentage change, for a month, from the corresponding month of the previous year is a reference to the percentage change in the CPI.
