(a)  in those parts of Ontario designated as Part 1 on the Suspended Snare Trapping Regulation Plan; or

(b)  in those parts of Ontario designated as Part 2 on the Suspended Snare Trapping Regulation Plan, during an open season for deer during which a person may use or be accompanied by a dog while hunting deer. O. Reg. 388/15, s. 9 (1).

(a)  a snare under the surface of any body of water; or

(b)  a foot snare or cable-live trap in a horizontal position on the ground.  O. Reg. 303/07, s. 7; O. Reg. 388/15, s. 9 (2).

(3) Despite subsection (1) and subject to section 17.1, a person permitted under clause 22 (2) (a), (b) or (c) of the Act to use a body-gripping trap may use a relaxing cable restraint to trap wolf or coyote under section 31 of the Act. O. Reg. 388/15, s. 9 (3).

O. Reg. 290/17, s. 5.

(5) For the purposes of this section, a reference to an open season for deer during which a person may use or be accompanied by a dog while hunting deer does not include an open season for deer during which a person is permitted under subsection 86 (4) of Ontario Regulation 665/98 (Hunting) to use a dog only to search for lawfully wounded deer. O. Reg. 388/15, s. 9 (3).

(6) In this section,

“Suspended Snare Trapping Regulation Plan” means the plan entitled “Suspended Snare Trapping Regulation Plan”, filed with the Office of the Surveyor General of Ontario in the Ministry and available from the Ministry. O. Reg. 388/15, s. 9 (3); O. Reg. 89/17, s. 3.
