Order in Council 642/2019

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas section 3.2 of the Environmental Assessment Act provides that where the Minister of the Environment, Conservation and Parks considers that it is in the public interest, having regard to the purpose of the Act and weighing it against the injury, damage or interference that might be caused to any person or property by the application of the Act to any undertaking or class of undertakings, the Minister, with the approval of the Lieutenant Governor in Council, may by order declare that the Act or the Regulations or a matter provided for under the Act does not apply with respect to a proponent, a class of proponents, an undertaking or a class of undertakings, and may impose conditions on the declaration, and may amend or revoke such conditions imposed on the declaration made under this section;

Whereas the Minister of the Environment, Conservation and Parks has been requested to amend conditions in declaration order MNR-75 pertaining to forest management on Crown Lands in Ontario, as described in that declaration order, under section 3.2 of the Act to allow forest management activities to be undertaken in the area identified in the amendments as the Cat-Slate Forest;

And whereas, having regard to the purpose of the Act and weighing the same against the injury, damage or interference that might result from the failure to amend Declaration Order MNR-75 to allow forest management activities to occur in the Cat-Slate Forest, the undersigned, Minister of the Environment, Conservation and Parks, considers that it is in the public interest to make an order amending the above noted declaration order,

Therefore, pursuant to the provisions of the Environmental Assessment Act, the attached order amending declaration order MNR-75 (OIC 1126/2015) be approved.
