Minister's Order: Ontario Wildlife Damage Compensation Program

Whereas the program known as the Ontario Wildlife Damage Compensation Program was established on July 1, 2011 by Order-In-Council 1313/2011 and continued by Order-In-Council 502/2016 for the encouragement of agriculture and food within Ontario;
And whereas section 7(8) of the Ministry of Agriculture, Food and Rural Affairs Act provides that a program established by the Lieutenant Governor in Council under section 7 of that Act before March 22, 2017 and that is still in effect on that day, is deemed, on and after that day, to be a program established by the Minister under section 6.2 of that Act;
And whereas the Ontario Wildlife Damage Compensation Program, meets the criteria set out under section 7(8) of the Ministry of Agriculture, Food and Rural Affairs Act and is deemed to be a program established by the Minister under section 6.2 of that Act;
And whereas sections 49 and 54 of the Legislation Act, 2006 has the effect of providing the Minister with the power to amend, revoke or replace from time to time an order establishing a program under section 6.2 of the Ministry of Agriculture, Food and Rural Affairs Act;
And whereas I, the Minister of Agriculture, Food and Rural Affairs, wish to make amendments to the Ontario Wildlife Damage Compensation Program.
Now therefore, and pursuant to my authority under sections 6.2 and 7(8) of the Ministry of Agriculture, Food and Rural Affairs Act and sections 49 and 54 of the Legislation Act, 2006, I hereby order the following:
Part 1 — Interpretation
1. For the purposes of this Order, the following terms will have the meanings set out below:
"OIC" means Order-In-Council 502/2016;
"Order" means this Minister's Order, number 0010/2018;
2. Any capitalized term not defined within this Order will have the same meaning as set out under the OIC.
Part 2 — Amendments to the Administration of the Program
3. Section 11(9)(c) of the OIC is revoked and replaced with:
- Any changes to the Guidelines will be effective as of the date set out therein; and
Part 3 — Amendments to Eligibility Requirements
4. The following provision is added as section 15(3) to the OIC:
(3) Despite section 15(2)(d), an Applicant will not be considered ineligible to receive compensation under this Program where that Applicant has failed to adhere to the filing dates in Ontario Regulation 722/93: Filing Dates, made under the Farm Registration and Farm Organizations Funding Act, 1993.
5. The following provision is added as section 15(2)(f) to the OIC:
- Have a valid Farm Business Registration Number in the current year or the year immediately preceding the current year or have a valid Farm Business Registration Number exemption.
This Order is effective as of the date of signature set out below.
