Excess soil fact sheets
Get detailed information on responsibilities for managing, transporting, reusing, and disposing of excess soil in O. Reg. 406/19: On-Site and Excess Soil Management (the regulation).
Purpose of the fact sheets
We have developed several fact sheets to help you understand and comply with the regulation.
While these fact sheets are intended to provide information on the regulation, they are not legal advice. All regulatory requirements relating to the management of excess soil are contained in:
- O. Reg. 406/19: On-Site and Excess Soil Management
- Rules for Soil Management and Excess Soil Quality Standards
- Part I: Rules for Soil Management
- Part II: Excess Soil Quality Standards
O. Reg. 153/04: Records of Site Condition – Part XV.1 of the Act and Reg. 347: General – Waste Management (Reg. 347) align with O. Reg. 406/19 and may be relevant to some soils or soil management sites.
Note that references to sections of O. Reg. 406/19, O. Reg. 153/04, Reg. 347 and the Environmental Protection Act (EPA) are made throughout the fact sheets and can be found on Ontario’s e-Laws website.
The Ministry of the Environment, Conservation and Parks (the ministry) will update the fact sheets as needed to ensure they provide accurate information and guidance.
While all efforts are made to ensure the accuracy of this information, if there is any discrepancy between the fact sheets and the Acts or regulations, the provisions of the Acts and regulations prevail.

The fact sheets provide topic-specific information on the regulation, and are divided into the following pages:
