On November 18, 2010, the Ministry of Finance announced that the Ontario government had negotiated the principal terms of a proposed agreement to renew to its long-standing business partnership with Teranet Inc., by extending its exclusive licences to provide electronic land registration and writs services in Ontario for an additional 50 years. As part of the terms of the agreement fee changes will take place in 2015.

The Minister’s Order contains both statutory fees under the Land Titles Act and Registry Act as well as certain other fees paid to the Ministry of Government Services’ service provider for electronic land registration services, Teranet Inc. The Electronic Land Registration Services Act, 2010 (ELRSA) now requires these fees be specified in a Minister’s Order. The fees in the schedules below described as “ELRSA Fees” are fees required to be specified in an order under Section 2(4) of the ELRSA. Those described as “Statutory Fees” are the fees established under the Land Titles Act, the Registry Act or the Administration of Justice Act. Fees shown in Schedules I, II and III are payable from December 16, 2010 to and including November 1, 2015. The overall cost for services has not changed.

On November 2, 2015 the fee for searching properties will be harmonized to $28.00 to equalize fees for searches done in land registry offices and those done remotely (at an LRO, through Teraview for a key LRO and through Teraview for a non-key LRO), as shown in schedule IV. For the purposes of the Bulletin and Schedule, “remote” means the service is not obtained at a land registry office, save for those services obtained at a land registry office from a self service kiosk that requires a license as described in Schedule III; and, “key” means the default LRO or EO associated with a license described in Schedule III to this Bulletin when used in reference to a Land Registry Office (“LRO”) or Writs Enforcement Office (“EO”).

In addition, the fees set out in Schedule I, (which will be amended as set out in Schedule IV), are to be adjusted by an accumulation of 50 per cent of inflation based on the consumer price index for each year between 2010 and 2015. It is anticipated that once it is known what the consumer price index for each year is set at, a new bulletin will be issued in the fall of 2015 to identify the fees applicable in November 2015. The fees in Schedules II and III will not be increased by the consumer price index.

As the fees in Schedule I will be adjusted by 50 per cent of the consumer price index annually beginning on November 2, 2016, it is expected that yearly communication of these changes will be made.
