What is happening?

Effective October 13, 2020, land surveyors will no longer need to attend a Land Registry Office in person to complete the registration of an amendment to condominium description creating a phase.

Information

Ontario Regulation 49/01 under the Condominium Act, 1998 was amended to make the preparation of phased condominium descriptions faster and more convenient than the current requirement of attending a Land Registry Office to draft amendments onto the original description sheets. 

The new process, as set out in Section 22 of Ontario Regulation 49/01 and available on eLaws, requires the land surveyor for the declarant to provide a proposed amended phased condominium description for approval by a land registrar. Once the land registrar has approved, the updated hardcopy sheets of the original description, and the plans of the lands, units and exclusive use portions included in the phase can be delivered to the appropriate Land Registry Office for registration.
