These particulars are posted pursuant to s. 49 (1) of the Private Career Colleges Act, 2005 (“Act”), providing particulars of a refusal to renew a registration following an order of the Licence Appeal Tribunal.

On October 28, 2021, the Superintendent of Private Career Colleges proposed to refuse to renew the registration of Best Payless Truck Driving School Ltd., operating as “Best Payless Truck Driving School” (“Best Payless”) and provided Best Payless with a notice of the proposed action pursuant to s. 19 of the Act. Best Payless.

On June 16, 2022, the Licence Appeal Tribunal directed the Superintendent to carry out the actions proposed in the Notice of Proposal to Refuse to Renew Registration of Best Payless Truck Driving School.

On June 21, 2022, the Superintendent carried out the proposed action as directed by the Licence Appeal Tribunal and refused to renew the registration of Best Payless Truck Driving School as a private career college pursuant to s. 19(4) of the Act.

Reasons for decision

The Superintendent has refused to renew Best Payless Truck Driving School Ltd. registration for the following reasons:

  • Best Payless breached a condition of the registration, providing grounds to refuse to renew the registration of Best Payless pursuant to subsection 18(2)(B) of the Act
    • Best Payless failed to provide its Commercial Truck Driver (Class A) vocational program in a manner consistent with the Commercial Truck Driver (Class A) training standard, Superintendent’s “Policy Directive for Truck Driver (Class A) training programs”, and conditions of Best Payless’ registration as a private career college
  • Best Payless failed to comply with provisions of the Act and the Regulations, providing grounds to refuse to renew the registration pursuant to subsection 18(2)(C) of the Act
    • Best Payless made substantial changes to an approved program without the further approval of the Superintendent, thereby contravening s. 23 (6) of the Act
    • Best Payless’ advertising contained content that misled the public to believe there was an approved campus of Best Payless offering Class A training in Cornwall, Ontario, and further guaranteeing successful completion of an approved vocational program, thereby contravening s. 16 (2) of O. Reg 415/06
    • Best Payless failed to maintain copies of advertising records thereby contravening s. 17 (1) of O. Reg 415/06
    • Best Payless failed to maintain translations for advertising published in a language other than English or French thereby contravening s. 17 (3) of O. Reg. 415/06
    • Best Payless provided false and misleading information to a designate of the Superintendent, in an effort to obstruct the inquiries of a designate of the Superintendent
  • The Superintendent was no longer satisfied that Best Payless met all requirements set out in subsection 14(1) of the Act, providing grounds to refuse the registration pursuant to subsection 18(2) (A) of the Act
  • Best Payless continued to operate in contravention of the Act and the immediate suspension of the registration will prevent further contravention

Superintendent’s Action

On June 21, 2022, the Superintendent carried out the proposal and refused to renew the registration of Best Payless Truck Driving School Ltd. as a private career college.
