Minister's letter: Revoke outdated regulation under the Quality of Care Information Protection Act, 2016

Under subsection 16(6) of the Quality of Care Information Protection Act, 2016 (QCIPA, 2016), the Minister may decide that the public consultation requirements under subsections 16(1) to (5) should not apply to the power of the Lieutenant Governor in Council to make a regulation. The Minister is required to provide public notice of this decision and a statement of the reasons for the decision.
On July 1, 2017, the Quality of Care Information Protection Act, 2004 (QCIPA, 2004) was repealed and replaced with the new QCIPA, 2016. At that time, regulations made under the former QCIPA, 2004 should have been revoked. The subject-matter of these regulations had been incorporated into regulations made under the new QCIPA, 2016, and it is necessary for the Lieutenant Governor in Council to revoke O. Reg. 330/04 (General) made under the former QCIPA, 2004.
The regulation required to revoke O. Reg. 330/04 (General) would be authorized by subsection 15(1) of the new QCIPA, 2016 and is subject to the public consultation requirements. The public consultation requirements should not apply because the revoking regulation merely removes requirements that have already been incorporated into O. Reg. 482/16 (General). The revocation would be considered a house-keeping measure.
I have determined that the foregoing proposed regulation to revoke O. Reg. 330/04 (General) is of a minor and technical nature.
