NOTICE OF APPLICATION FOR AN ORDER TO CLOSE A PART OF A CEMETERY

Provided pursuant to section 88 of the Funeral, Burial and Cremation Services Act, 2002, S.O. 2002, Chapter 33 (the “Act”) and section 172 of O. Reg. 30/11 made under the Act

The St. John Anglican Cemetery (the “Cemetery”) is located at 3027 Pierce Road in Pierce’s Corner, Ottawa. The registered cemetery is approximately 1,980 square meters in size, and includes a church which was deconsecrated in 2007 (St. John the Evangelist, also known as St. John the Baptist), manicured lawns, a drive shed, and 29 interments and 12 markers in a partially fenced area lying to the east of the former church. This Cemetery, which no longer accepts human remains for interment purposes, does not have a heritage designation under the Ontario Heritage Act.

take notice that, pursuant to section 88 of the Funeral, Burial and Cremation Services Act, 2002, S.O. 2002, Chapter 33, the undersigned intends to make an application for an Order to close part of this Cemetery. The part to be closed covers a total of 1,320 square meters, and is comprised of the former church, the drive shed, and the manicured lawns to the west of the former church building. Apart from one unmarked infant gravesite, which was unrecorded and discovered as a result of an archaeological assessment, there are no other interments or scatterings in the part of the Cemetery to be closed. The part which is not being closed is located in a partially fenced 660 square meter area lying to the east of the former church. There are 29 interments and 12 markers in this part of the Cemetery. The Anglican Parish of North Gower is seeking to remove the cemetery designation from part of the Cemetery so that a well and septic system can be installed, and the former church building sold as a private residence. The Parish believes that this will ensure that the former church is preserved.

take further notice that, the applicant will request that the Registrar include in the Order to close, the manner in which the infant gravesite will be disinterred from the part of the Cemetery to be closed, and re-interred in the part which is not being closed.
