Notice of approval

Proponent: The Regional Municipality of Sudbury

Take notice that the period for requiring a hearing, provided for in the Notice of Completion of the Review for the above noted undertaking, expired on December 22, 1998. I received no submissions before the expiration date.

I do not consider it advisable or necessary to hold a hearing. Having considered the purpose of the Act, the Environmental Assessment, and the Review, I hereby give approval to proceed with the undertaking, subject to the conditions set out in this Notice.

Reasons

My reasons for giving approval are:

  1. On the basis of the proponent’s Environmental Assessment and the Review, the proponent’s conclusion that, on balance, the advantages of this undertaking outweigh its disadvantages appears to be valid.
  2. No other beneficial alternative method of implementing the undertaking was identified.
  3. On the basis of the proponent’s Environmental Assessment and the Review, the construction, operation and maintenance of the undertaking will be consistent with the purpose of the Act (section 2).
  4. The Government Review Team has indicated no outstanding concerns that can not be addressed through conditions of approval under the Act or under the Environmental Protection Act.
  5. I am not aware of any outstanding issues with respect to this undertaking which suggest that a hearing should be required .

Conditions

The approval is subject to the following conditions:

  1. Definitions:
    Site Liaison Committee or SLC
    refers to rep resentatives from across the Region, with the intention of including at least one member from each area municipality.
    landfill site or the site
    refers to the existing City of Sudbury waste disposal facility (landfill).
    regional staff
    refers to the staff employed by The Regional Municipality of Sudbury.
    EA
    refers to the Environmental Assessment.
    proponent
    refers to The Regional Municipality of Sudbury.
    affected parties
    refers to any organization, agency, municipality or members of the public who are directly or indirectly affected by the undertaking.
    Public Record
    refers to the file for the undertaking which can be viewed by the public and which is stored at the Environmental Assessment and Approvals Branch.
  2. The proponent shall comply with the provisions of the Environmental Assessment, all of which are hereby incorporated by reference, except as amended by these conditions and by any requirement of the Part V, Environmental Protection Act, Provisional Certificate of Approval for the site, and any other approvals or permits that may be issued.
  3. These conditions do not prevent more restrictive conditions being imposed under other statutes.
  4. The proponent shall make every reasonable effort to establish and maintain a Site Liaison Committee (SLC). The Committee shall serve as a focal point for dissemination, review and exchange of information and monitoring results, between the proponent and the public, relevant to the operation of the landfill.
  5. Within six months of the date of this Environmental Assessment Act approval, a Mandate for the SLC shall be prepared by the proponent in consultation with the public and shall be submitted to the Director, Northern Region, Ministry of the Environment for approval. The Director may amend the Mandate submitted to him, including the composition of the Committee membership as required by these Conditions before approving the Mandate and may amend the Mandate from time to time. When approved, a copy shall be filed with the Public Record.
  6. The proponent’s consultants' reports shall be provided by the proponent to the SLC.
  7. The proponent will carry out the studies committed to in Section 8.2 of the EA and the commitments described in the letter of December 10, 1998 to the Director of the Environmental Assessment and Approvals Branch of the Ministry of the Environment.
  8. The proponent shall develop a procedure for consulting affected parties if significant changes in the conceptual design of the landfill or related mitigation measures are proposed. The proposed consultation procedure shall be submitted to the Director of the Environmental Assessment and Approvals Branch for approval. No significant change may be processed under the Environmental Protection Act unless it is proceeding in accordance with the approved consultation procedure.
  9. The proponent shall issue a report once the landfill has commenced operation, outlining the success and progress of the 3Rs activities in The Regional Municipality of Sudbury. The report will outline any proposed activities or programs to improve the level of waste diversion from the landfill. This report shall be filed with the Public Record.
  10. Where these conditions require a document to be filed with the Public Record, the proponent shall provide the document to the Director of the Environmental Assessment and Approvals Branch of the Ministry of the Environment for filing with the Public Record maintained for this undertaking. Additional copies of all such documents will be provided by the proponent to the Sudbury District Office of the Ministry of the Environment and the Site Liaison Committee.
