Approval of the terms of reference for the Class EA for Remedial Flood and Erosion Control Projects
The ministry’s approval of class environmental assessment terms of reference for Conservation Authority projects that protect human life and property from potential flood or erosion problems.

As provided for by section 6(4) of the Environmental Assessment Act, Terms of Reference, as submitted for approval to the Ministry of the Environment on June 1, 2000, to govern the preparation of an environmental assessment for the above-noted undertaking, are hereby approved.
Reasons
I am satisfied that an environmental assessment carried out in accordance with the Terms of Reference will be consistent with the purpose of the Environmental Assessment Act and the public interest for the following reasons:
- The Terms of Reference are for the preparation of an environmental assessment for a class of small-scale projects with predictable environmental effects which have generally accepted methods of mitigation.
- The Terms of Reference are for the review and renewal of an existing environmental assessment that has been in use for over 7 years without any significant concerns or issues associated with its use. The Terms of Reference identify the significant environmental issues relevant to this undertaking.
- The Terms of Reference identifies issues and concerns, and the preferred means of addressing them with due regard to adoption of environmental management, protection and mitigation measures, and requires the proponent to prepare an environmental assessment that will address these issues appropriately.
- As the Terms of Reference have been prepared pursuant to section 6(2)(c) and pursuant to section 6.1(3) of the Environmental Assessment Act, the resulting environmental assessment will consist of the information outlined in the Terms of Reference.
- The Terms of Reference has been reviewed by the Government Review Team which has indicated no outstanding concerns. The Terms of Reference were also posted for comment on the web-sites of both Conservation Ontario and the Ministry of the Environment for a thirty day period. No comments were received.
- The Terms of Reference require the proponent to implement a comprehensive consultation plan outlining the timing and types of consultation during the preparation of the environmental assessment. Pursuant to subsection 6.1(1) of the Environmental Assessment Act, any environmental assessment for the above-noted undertaking, submitted to the Ministry of the Environment pursuant to subsection 6.2(1) of the Environmental Assessment Act, must be prepared in accordance with the Terms of Reference as hereby approved.
