Particulars of a Restraining Order

s. 49 (1) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the issuance of a Restraining Order against a director of a registered career college by the Superintendent of Career Colleges pursuant tos. 49 (1) of the Act.

Contraventions

The Superintendent has ordered Brinderpal Singh Thind (“Brinderpal”) to:

  1. Stop obstructing the inquiries or examinations of the Superintendent or designate of the Superintendent contrary to subsection 38 (10) of the Act;
    1. On October 11, 2024, Brinderpal obstructed the inquiries of the designates of the Superintendent contrary to subsection 38 (10) of the Act by refusing to answer questions of a designate of the Superintendent and providing them with false or misleading information.
  2. Fulfil Brinderpal’s duty to assist the inquiries and examinations of the Superintendent or designate of the Superintendent as required by subsection 38 (6) of the Act.
    1. On October 11, 2024, Brinderpal failed to fulfil your duty to assist provided by subsection 38 (6) of the Act when you failed to produce documents, records, and other things required to be produced by a designate of the Superintendent conducting inquiries and examinations pursuant to section 38 of the Act.

Required Actions

By January 28, 2025, Brinderpal is required by the Superintendent to provide written and signed confirmation, together with all available supporting evidence, confirming that they:

  1. Will not hinder, obstruct, or interfere with the inquiries or examinations of the Superintendent of Career Colleges or designates of the Superintendent as prohibited by subsection 38 (10) of the Act and further prohibited by this order; and,
  2. Will fulfil your duty to assist the inquiries or examinations of the Superintendent of Career Colleges or designates of the Superintendent as provided by subsection 38 (6) of the Act and as further required by this order.
