Background

In 2017, the Minister Responsible for Accessibility established the Employment Standards Development Committee—a group of representatives from the employment sector, municipalities, persons with disabilities—to make recommendations on our existing employment standards.

Recommendations

The Committee put forward initial recommendations and asked for public feedback to help them draft their final recommendations to the Minister Responsible for Accessibility.

The Employment Standards Development Committee has reviewed all comments, finalized their recommendations and submitted them to the Minister for Seniors and Accessibility for consideration. Read the committee’s final recommendations.

Scope and timelines

A standards development committee will review the employment standards, as prescribed in Section 9 of the AODA. It is summarized as follows:

  1. Re-examine the long-term objectives of the standards
  2. If required, revise the measures, policies, practices and requirements to be implemented on or before January 1, 2025, and the timeframe for their implementation;
  3. Develop another proposed accessibility standards containing modifications or additions that the committee deems advisable for public comment
  4. Make such changes it considers advisable to the proposed accessibility standards based on comments received and make recommendations

The committee should also consider all possible solutions and tactics, including non-regulatory approaches.

The Ministry for Seniors and Accessibility has undertaken research and consultations with people with disabilities and obligated organizations. Consultation sessions included approximately 40 participants. The main themes of feedback included:

  • clarity of requirements for individual accommodation plans
  • a desire for clear guidance materials
  • disclosure of disability is generally needed to meet requirements
  • obligated organizations are currently implementing new requirements

The minister asked the committee to focus the review on requirements for sectors that have been in effect for more than 24 months, as well as to identify any gaps that may remain in the standards.

Ontario has announced that it will develop a comprehensive strategy to enhance employment opportunities for persons with disabilities. The employment strategy is supported by the specific standards. Any issues or considerations regarding the advancement of employment opportunities for persons with disabilities will continue to align with discussions around the strategy.

Throughout the process, the members of the Accessibility Standards Advisory Council sitting on the standards development committee are encouraged to keep the council informed of the committee’s progress.

Guidelines for recommendations:

The following guidelines are intended to support the work of the committee as they develop their recommendations:

  1. Respect, and be complementary to, the principles, purpose and requirements of the AODA, and support the end-goal of achieving accessibility for Ontarians with disabilities on or before January 1, 2025, taking into account:
    • the range of disabilities that the measures, policies, practices and requirements are intended to address
    • the nature of the barriers that the measures, policies, practices and requirements are intended to identify, remove and prevent
    • any technical and economic considerations/ impacts that may be associated with their implementation (for example, for obligated organizations, sectors, and the province more broadly)
  2. Focus efforts on preventing barriers both now and in the future.
  3. Work within existing Ontario legislative and regulatory frameworks.
  4. Focus on simplification and clarity of the standard where possible.
  5. Consider inter-jurisdictional best practices and innovative solutions (such as those from emerging “shared” economies), keeping in mind the context of Ontario’s current regulatory framework around organizations with one or more employee(s), municipalities, and other obligated organizations in meeting or exceeding standard requirements.
  6. Recognize that while workplaces should be integrated and accessible to people with as wide a range of disabilities and abilities as possible, there will continue to be a need for individual accommodation for persons with disabilities.
  7. Consider economic implications and feasibility for the sector to comply.
  8. Consider the ‘enforceability’ of the requirements to support compliance and enforcement of the standard.
  9. Where appropriate, reflect international standards, legislation, regulation, codes, and best practices in Ontario, other provinces and internationally, in the area of accessible employment.

Key deliverables and timelines

The committee will complete the following key deliverables within the specified timelines:

  1. Mandatory orientation and training—all members of the committee will complete an initial orientation and training during the first meeting of the committee.
  2. Meetings—the committee will meet for one or two-day sessions, approximately every six weeks as needed.
  3. Committee work plan—the committee will prepare and provide to the minister a draft work plan early in the review. The work plan will outline key milestones, activities and timelines to achieve the mandate described in this letter.
  4. Proposed recommendations for revisions to the standard—within six months or sooner of the first meeting, the committee will deliver to the Minister proposed recommendations for public review.
  5. Finalizing recommendations for revisions to the standard—a report on comments received during the public review will be prepared by the Ministry for Seniors and Accessibility and the comments will be given to the committee for its consideration. The committee will consider public comments, seek additional information if needed, and make changes to the proposed revisions based on public comments as the committee deems advisable. The committee will submit the final recommendations to the minister, along with a report on its consideration of public comments, no more than 14 weeks after receiving the report and public comments.
  6. Meeting minutes and progress reports—no later than four weeks following each of its meetings, the committee will approve and provide the Minister a copy of its meeting minutes which are to include a progress report on the review of the Employment Standard.

M 6.1 Logistics and Housekeeping

M 6.5 Stakeholder Presentation - AODA Alliance

  • AODA Alliance highlighted the importance of accessible procurement practices, the changing nature of employment relationships, and the built environment so that workplaces will be accessible to people with disabilities both now and in the future.
  • A question and answer session followed the presentation.

M 6.6 Introductory Discussion on Public Feedback Received

  • Staff provided an overview of the public feedback received during the public posting period, including overall highlights.

M 6.7 Stakeholder Presentation - ARCH Disability and Law Centre

  • ARCH Disability highlighted that the AODA should be more rights-based and that there should be increased enforcement measures, along with mechanisms to foster greater accessibility.
  • A question and answer session followed the presentation.

M 6.8 Long Term Objective:

  • Staff provided an overview of the public feedback received on the long-term objective.
  • Facilitated by the Chair, the committee held a discussion and agreed to add context to the narrative around the long-term objective, confirming that the report reflected committee discussions and resolutions.

M 6.9 Recommendation 1: Improved Clarity with the Ontario Human Rights Code

  • The SDC recommends the government and the Ontario Human Rights Commission review and strengthen guidelines and clarification for employers with regard to the differences between Ontario Human Rights Code and the AODA’s Employment Standards.
  • Note: By “review” the committee intends the government and the OHRC to explore the causes of confusion regarding the relationship between the AODA and the Ontario Human Rights Code as a first step.

M 6.10 Recommendation 2: Scope and Interpretation

  • “The SDC believes a gap exists because a definition of “employee” is not included in the AODA and Integrated Accessibility Standards Regulation (IASR). The SDC recommends a definition of “employee” should be added to the AODA or IASR and be consistently applied throughout. This definition should be consistent with the intent and purpose of the AODA and should be based on the employer–employee relationship.”
  • Note: The SDC intends that any definition of employee added to the AODA or IASR align with and consider existing employment legislation.

M 6.11 Recommendation 3: Recruitment, General

  • Staff provided an overview of public feedback, including a recap of discussions that the committee had in arriving at the initial recommendation.
  • Facilitated by the Chair, the committee had a discussion, then voted on recommendation 3 to maintain the recommendation without changes.

  • “In order to fully inform job applicants, the SDC recommends Section 22, notice of availability of accommodations throughout recruitment by employers, should be expanded to include notice of availability of accommodation during employment.
  • The policy intent of this recommendation is to amend Section 22 notice, and not to expand other requirements of the accessible Employment Standards. The rationale of the recommendation is that this provides applicants better awareness of their right to accommodation during the employment lifecycle. The requirement to accommodate throughout employment under the Ontario Human Rights Code may currently not be clear.”

M 6.12 Recommendation 4: Recruitment, Assessment and Selection Process

  • “The SDC recommends guidelines and best practices should be developed on how to make the recruitment, assessment and selection processes and materials inclusive by design.
  • Some employers may need additional resources (e.g. how to have conversations with candidates/employees during the recruitment, assessment and selection processes). Government should provide the materials.”

M 6.13 Recommendation 5: Notice to Successful Applicants

M 6.14 Recommendation 7: Centralized Portal for Individualized Accommodation Plans

  • “The tools and resources that exist for individual accommodation plans are not easy to find and use outdated language. The SDC recommends the government should be responsible for a centralized portal for updated resources for individualized accommodation plan processes.”
  • Note: The intent of the recommendation is that the tools and resources align with the OHRC’s policies on the procedural duty to accommodate. In addition, the OHRC should be consulted to ensure harmonization.

Recommendation: The desired outcome of Section 27 is to ensure accessible emergency response information is available to all employees with disabilities in accessible formats, upon request

Section 27 makes references to “individualized” emergency response information. The SDC believes the use of the word “individualized” may result in obligated organizations unnecessarily developing individualized emergency response plans. The SDC recommends the word “individualized” be removed from Section 27.

Questions of individualized emergency plans and emergency accommodations needs are best addressed as part of Section 28 individualized accommodation plans.

Recommendation Note: If the word “individualized” is removed from Section 27, consequential amendments will need to be made to Section 28(3).

  • Jeff Poirier, Policy Analyst from the Ontario Human Rights Commission answered Committee questions on the relationship between the Code and the accessible Employment Standards.

Recommendation: References in Section 27 to employers providing “individualized workplace emergency response information” may lead employers to believe they are required to develop detailed individualized emergency response plans.

This is not practicable for all organizations and may not accurately reflect the practices of emergency first responders.

Section 27 does not and should not be interpreted to require the creation of individualized emergency response plans; this clarification may be accomplished through regulatory or non-regulatory solutions.

Where employees require individual accommodations, this should be captured under Section 28.

Recommendation: Section 29 fills the gap for non-Workplace Safety and Insurance Act related return to work situations. The government should review Section 29 to harmonize the requirements under this section with return to work processes under other legislation, so employers are not required to have more than one return to work process. Duplicative return to work processes may be onerous and confusing.

Motion 3.9.1

  • With respect to Section 20 (Scope and Interpretation) of the Employment Standards, the Committee voted on the following recommendation:

Recommendation A gap exists because a definition of employee is not included in the AODA and the IASR. A definition of “employee” should be added to the AODA/IASR, as appropriate, and be consistently applied throughout the AODA/IASR.

This definition should be consistent with the purpose and intent of the AODA/IASR and should be based on the employer-employee relationship.

Motion 3.9.2

  • With respect to Section 20 (Scope and Interpretation) of the Employment Standards, the Committee voted on the following recommendation:

Recommendation: We agree it is appropriate for unpaid workers and volunteers to be excluded in the employment standard because the standard is meant to cover the employer-employee relationship. However, we recognize unpaid workers and volunteers may require accommodations to complete their duties without barriers. We would ask the government explore how to address this gap, including the use of regulatory and non-regulatory tools.

  • With respect to Section 22 (Recruitment, General), of the Employment Standards, the Committee voted on the following recommendation:

Recommendation: In order to fully inform job applications, s. 22 notice regarding availability of accommodations throughout recruitment by employers should be expanded to include notice of availability of accommodation during employment.

Day 2 meeting minutes

M1.7 Housekeeping Items, Logistics and Emergency Information

  • Ryan Nichols provided the committee with an overview of logistics and emergency information.

M1.8 Pre-Consultation Feedback

  • Asim Zaidi and Alex Ibrahim gave a presentation on pre-consultation feedback which included stakeholder feedback and research. The Committee asked follow up questions and had a discussion

M1.9 Compliance Presentation

  • Benjamin St. Louis gave a presentation on compliance outcomes and data related to the Employment Standards, and took questions from the Committee.

M1.10 Public Education and Partnerships Presentation

  • Geordie Gibbon gave a presentation on public education, marketing campaigns and partnerships relevant to the Employment Standards, and took questions from the Committee.

  • Laura McKeen introduced the Draft Workplan and led a group discussion. Committee members also discussed questions to provide to their stakeholders before the next meeting.
