These particulars are posted following the issuance of an administrative penalty by the Superintendent of Private Career Colleges pursuant to s.39(1) of the Act for which a review was not requested.

Description
Private Career Colleges Act, 2005, s. 38(6) Duty to assist
1960512 Ontario Ltd., operating as Great Truck Driving School ("Business") failed to fulfil its duty to assist provided by subsection 38(6) of the Act.
A designate of the Superintendent required the Business to provide assistance pursuant to section 38 of the Act (produce documents for review) and the Business failed to provide assistance in the manner required and within the time required.
This penalty may accumulate daily pursuant to subsection 51(3) of O. Reg. 415/06.

The Business, while not registered and its programs not approved, offered or provided a vocational program contrary to subsection 8 (1) of the Act.
After the expiry of its registration, the Business continued to offer and provide its previously approved vocational program to students.

The Business, while not registered and its programs not approved, charged or collected fees in relation to a vocational program contrary to subsection 9 (1) of the Act.
After the expiry of its registration, the Business continued to charge and collect fees from students in relation to its previously approved vocational program.

The Business, while not registered, operated as a private career college contrary to subsection 7(1) of the Act.

While registered, the Business failed to comply with conditions of its registration as a private career college contrary to subsection 15 (3) of the Act.
Statements of the Business, together with student files obtained from the Business' campuses, provide that the Business did not ensure that each student admitted into a vocational program met the admission requirements of that program as required by a condition of the Business' registration provided by subsection 19(1) of the Act.

At the time of these particulars, the Business has not provided the items required under subsection 38(6) of the Act, thereby continuing to contravene that provision for fifteen successive days.
Pursuant to subsection 51(3) of O. Reg. 415/06, the Administrative Monetary Penalty applied for contravention of subsection 38(6) of the Act has at time of writing accrued to $15,000, providing a total penalty of $20,500.
