Ontario’s 2022 nomination allocation reached

The Ontario Immigrant Nominee Program (OINP) has reached its 2022 nomination allocation. The program issued a total of 9,750 nominations to successful applicants across all streams in 2022.

New applications, and applications already submitted to the OINP, will continue to be accepted and considered under the program’s 2023 nomination allocation.

The most up to date status information can be found by logging into your account via our e-Filing portal. Our telephone Inquiry Officers do not have any additional status information.

Invitations to Apply to the Entrepreneur Stream

On December 22, 2022 the Ontario Immigrant Nominee Program (OINP) issued 14 invitations to apply under the Entrepreneur Stream. Expressions of interest scored by December 15, 2022 were eligible for consideration for this round.

Invitations to apply were issued for expressions of interest that received a score of between 140 and 173.

If you received an invitation to apply, you do not need to contact the program. You will receive two emails containing login information and instructions for submitting an application.

If you received a notice that your expression of interest was eligible to receive an invitation to apply but did not receive an invitation to apply this round, the expression of interest scored below 140. An expression of interest remains eligible to receive an invitation to apply for 12 months from the date it was submitted to the OINP.

The Ontario Immigrant Nominee Program (OINP) has implemented the National Occupational Classification (NOC) 2021 system as required by the Federal government.

The OINP e-filing system has now re-opened and reflects the implementation of the OINP 2021 system.

Please resubmit your Expression of Interest profile now. To make re-submitting easier, your previous submission is still available to you.

Introduction of Federal National Ocupational Classification (NOC) 2021

Effective today, the Ontario Immigrant Nominee Program (OINP) is required by the Federal government to adopt the new National Occupational Classification (NOC) 2021 system.

As part of this transition, the OINP e-filing system is temporarily closed to new activity between November 16 and November 21, 2022.

Individuals with expression of interest (EOI) profiles that were submitted before November 16, 2022 will need to re-submit their EOIs once the system re-opens. To make re-submitting easier, previous submissions are still available to individuals.

During the temporary closure period, individuals will be able to access applications that were previously submitted and check processing status, but will not be able to complete any new activity.

Changes to expression of interest scoring

Effective today, the OINP is implementing updates to the EOI scoring factors. The updated scoring matrix is designed to enhance regionalization, improve operational efficiency, and reduce the program’s exposure to program integrity risks.

The Ontario Immigrant Nominee Program (OINP) is pleased to announce an update on the Entrepreneur Pilot.

Administered by the Toronto Business Development Centre (TBDC), the pilot has been launched as the OINP Entrepreneur Success Initiative (OINP-ESI).

Announced as part of the 2021 Ontario Economic Outlook and Fiscal Review: Build Ontario, the initiative will help 100 immigrant entrepreneurs to establish and grow businesses across the province outside of the Greater Toronto Area.

Proposed regulatory amendments

The Ministry of Labour, Immigration, Training and Skills Development is proposing amendments to Ontario Regulation 422/17 (General) that will impact the Ontario Immigrant Nominee Program (OINP).

The proposed amendments would align the OINP with the new National Occupational Classification (NOC) 2021 system that is already in use by Employment and Social Development Canada (ESDC) and Statistics Canada (StatCan) as their official classification system. Immigration, Refugees and Citizenship Canada (IRCC) will also be implementing NOC 2021 in November.

The implementation of NOC 2021 will impact which occupations are eligible for each OINP stream. Prospective OINP applicants are encouraged to review full details of the NOC 2021 system on the Statistics Canada website and on IRCC’s website, as well as to stay informed by following updates on the OINP website.

In addition to regulatory amendments to align with NOC 2021, the Ministry is proposing updates to language criteria for the Employer Job Offer Foreign Worker stream, education criteria for the Employer Job Offer International Student stream, and changes to the minimum amount for the OINP’s administrative monetary penalties.

The amendments are now posted on Ontario’s Regulatory Registry for public consultation.

Feedback on these proposed changes can be submitted during the consultation period which ends on October 21, 2022.

2021 OINP results

Demand for the Ontario Immigrant Nominee Program (OINP) continues to be strong despite the impact of the COVID‑19 pandemic.

In 2021, the province’s nomination allocation from the federal government was 8,350 nominations. An additional 250 nominations were allocated to Ontario through the National Occupational Classification-Level C (NOC C) Pilot, a Federal-Provincial partnership to increase permanent resident pathways for in-demand, lower-skilled workers with job offers. The OINP met its full 2021 nomination allocation.

In addition to the province’s initial allocation, the federal government granted Ontario an additional 400 nomination spaces which were also fulfilled before year end. Including this year-end increase, the OINP was able to nominate 9,000 individuals in 2021, including 250 applicants through the NOC C Pilot.

In 2021, the OINP saw a high number of nominations in technology-related occupations. Approximately 25% of all nominations were to individuals citing work experience or a job offer in a high-tech occupation, including:

  • software engineers and designers
  • computer programmers
  • interactive media developers
  • IT systems analysts
  • technology consultants

The OINP continues its commitment to address labour market needs for skilled trades. In 2021, roughly 15% of nominees had work experience in a skilled trade with over 800 nominations made under the program’s Employer Job Offer: Foreign Worker and Employer Job Offer: In-Demand Skills streams. The top skilled trades occupations of nominees were: Transport truck drivers, Cooks, Machinists and machining and tooling inspectors, Carpenters, and Bricklayers.

The OINP also nominated health workers to address labour shortages in health care. The program nominated over 100 health care workers in 2021, including approximately 50 personal support workers.

In 2019, OINP committed to undertake a two-year pilot (2020–2021) to support employers in three pilot communities, outside of the Greater Toronto Area, to leverage the OINP to target skilled labour that is not available locally. Since its launch during the pandemic in 2020, the pilot has seen great success with over 226 nominations. In early 2022, OINP will process the remaining applications and is projected to meet the 300 nominations goal for the two-year pilot.

The program also surpassed its 5% target for francophone immigration, issuing 5.3% or 480 nominations to individuals with high French language proficiency. Most francophone applicants received nominations under the French-Speaking Skilled Worker stream and the Human Capital Priorities stream.

In 2021, the program issued its second nomination under its Entrepreneur stream. By the end of the year, 32 other applicants were in the stream’s compliance monitoring process, including nine applicants living in Ontario and working to establish their business. We anticipate that these 32 Entrepreneur stream candidates will invest over $25.2 million dollars and hire 133 Ontarians as a result of establishing their businesses in the province. In 2021, the OINP nominated individuals with job offers from over 2,200 employers across every industry in Ontario. At least 39% of nominees already had a job offer in Ontario prior to nomination.

While the program’s aim is to be responsive to employer needs and to be available year-round, the OINP continues to experience substantial demand for its streams in 2021, far surpassing its annual nomination allocation.

Issued invitations to apply to the entrepreneur stream

On July 15, 2022 the Ontario Immigrant Nominee Program (OINP) issued 33 Invitations to Apply (ITAs) under the Entrepreneur Stream (OINP:ES). Expressions of Interest (EOIs) received and scored by the OINP:ES by July 8, 2022 were eligible for consideration for this ITA Round.

ITAs were issued for EOIs that received a score of between 146 and 174.

If you received an ITA, you do not need to contact the program. You will receive two emails containing login information and instructions for submitting an application.

If you received a notice that your EOIs was eligible to receive an ITA but did not receive an ITA this round, the EOIs scored below 146. An EOIs remains eligible to receive an ITA for 12 months from the date it was submitted to the OINP.

The Ontario Immigrant Nominee Program (OINP) is pleased to announce that the Toronto Business Development Centre (TBDC) has been selected to deliver the Entrepreneur Pilot for two-years.

Announced as part of the 2021 Ontario Economic Outlook and Fiscal Review: Build Ontario, the Entrepreneur Pilot will help 100 immigrant entrepreneurs to establish and grow businesses across the province outside of the Greater Toronto Area. The jobs and investments these businesses generate will help to support soon to be selected regions needing the most help recovering from COVID‑19.

Identified through a publicly posted competitive request for bids, the TBDC is now working closely with the OINP to develop and launch the pilot. Please continue to monitor this space for future updates.

Publishing orders for contravention of the Ontario Immigration Act by individuals, employers and representatives

Effective May 3, the Ontario Immigrant Nominee Program (OINP) will publish the names of individuals, employers and representatives who have had an administrative monetary penalty or banning order imposed against them for contravening the Ontario Immigration Act, 2015.

When applying to the OINP, individuals, employers and representatives must provide information that is:

  • accurate
  • correct
  • not misleading

Providing inaccurate, incorrect or misleading information may result in penalties.

Publishing contraventions of the Act is an important measure to protect the public and further strengthen the integrity of the program.

Notice to candidates that received a notification of interest under the Express Entry Human Capital Priorities stream on February 22, 2022

The OINP targeted candidates with a comprehensive ranking system score between 455 and 600 and whose IRCC profiles were created between February 22, 2021 and April 29, 2021.

If your Express Entry profile expires before submitting your OINP application, you must create a new Express Entry profile then upload to your OINP application:

  • a copy of the letter you received from IRCC acknowledging the new profile with the Express Entry number and job seeker validation code visible
  • a copy of the letter you received from IRCC acknowledging the expired profile with the Express Entry number and job seeker validation code visible
  • a copy of the profile expiration letter received from IRCC.

Failure to notify the program of your new Express Entry profile will result in your application being returned as incomplete and your application fee refunded.

If your Express Entry profile expires during the processing of your OINP application, you must notify us as soon as possible by email at ontarionominee@ontario.ca and include the documents above.

Introducing an updated process for registering an expression of interest for the Entrepreneur Stream

The Ontario Immigrant Nominee Program (OINP) updated the process for registering an expression of interest (EOI) for the Entrepreneur Stream and has resumed accepting EOIs.

If you are interested in being invited to apply to the Entrepreneur Stream, you can now register an EOI using the e-Filing Portal.  Applicants no longer have to contact the program to request an EOI registration form. This update only applies to the Entrepreneur Stream.

If you registered an eligible expression of interest prior to February 23, 2022, OINP staff will manually transition it into the e-Filing Portal. OINP staff will notify the EOI registrants, and/or their representatives, impacted by this transition by email about how to access their EOI in the e-Filing Portal.

This updated process does not change the Entrepreneur Stream’s regulated requirements.

Updated Conditions and/or Restrictions of Approval under the Employer Job Offer streams

On December 8, 2021, the Ontario Immigrant Nominee Program updated the standard conditions and/or restrictions of approval for applicants for certificates of nomination and employment positions under the Employer Job Offer streams.

Nominees and employers must comply with all conditions. Failure to comply may result in the cancellation of your approval.

If you were nominated under an Employer Job Offer stream you must:

  1. continue to demonstrate on a reasonable basis an intention to reside in Ontario.
  2. be employed in the approved employment position as of the date of your nomination, if you are already working for the employer.
  3. apply for a work permit within six (6) months and begin working in the approved employment position within ten (10) months from the date of your nomination, if you are not already working for the employer.
  4. inform the OINP immediately in writing if you have not begun working in the approved employment position within ten (10) months from the date of your nomination.
  5. continue to be employed in the approved employment position during the nomination period (i.e. until you receive permanent residence). This means that your terms of employment must remain consistent throughout the nomination period, including your:
    • employer
    • position title and duties
    • wage
    • hours of work
    • work location
  1. notify the OINP immediately in writing if there is a change in the nature of your employment, including any of the above terms of employment by contacting the OINP at ontarionominee@ontario.ca.

Your nomination may be cancelled if:

  • the above conditions and/or restrictions are not met
  • the employer withdraws your job offer
  • you decline your job offer
  • your employment is terminated either by you or the employer

If you are an employer approved for an employment position under an Employer Job Offer stream, you must:

  1. employ the nominee in the approved employment position as of the date of nomination if the nominee is already working for you.
  2. employ the nominee in the approved employment position within ten (10) months as of the date of nomination if the nominee is not already working for you.
  3. inform the OINP immediately in writing if the nominee has not begun working in the approved employment position within ten (10) months from the date of nomination.
  4. continue to employ the nominee in the approved employment position during the nomination period (i.e. until the nominee receives permanent residence). This includes the following terms of employment:
    • position title and duties
    • wage
    • hours of work
    • work location
  1. notify the OINP immediately in writing if you are no longer able to comply with any of the above conditions and/or restrictions by contacting the OINP at ontarionominee@ontario.ca.

The approval of the employment position and the nomination may be cancelled if:

  • the above conditions and/or restrictions are not met
  • you withdraw the job offer
  • the nominee declines the job offer
  • the nominee’s employment is terminated either by you or the nominee

Conditions of nomination are authorized under section 17 of the Ontario Immigration Act, 2015, S.O. 2015, c. 8 (Act). Failure to comply may result in the cancellation of the approval in accordance with section 18 of the Act.

Regulatory amendment impacting the Employer Job Offer: In-Demand Skills stream

The Ministry of Labour, Training and Skills Development has implemented a regulatory amendment impacting the Ontario Immigrant Nominee Program’s Employer Job Offer: In-Demand Skills stream. The amendment can be found at Ontario Regulation 31/22 (General) (made to Ontario Regulation 422/17 (General)) and will:

  • require employers seeking an approval of a NOC 7511 (Transport truck drivers) employment position under the Employer Job Offer: In-Demand Skills stream to demonstrate that they have a valid Commercial Vehicle Operator’s Registration (CVOR) certificate and a Carrier Safety Rating (CSR) of Excellent, Satisfactory or Satisfactory Unaudited.

The amendment aims to:

  • protect successful nominees and support public safety on Ontario highways as employers without an acceptable safety rating will be ineligible for approval
  • promote applications from employers with clear business ties to the province, since employers will be required to have their vehicles plated in Ontario

The amendment is effective February 1, 2022.

The Ontario Immigrant Nominee Program (OINP) has reached its 2021 nomination allocation and continues to notify successful applicants. The Ontario Immigrant Nominee Program issued a total of 9,000 nominations to successful applicants across all streams in 2021, including 400 additional nominations received through an in-year reallocation and 250 NOC skill level C nominations.

New applications, and applications already submitted to the OINP, will continue to be accepted and considered under the program’s 2022 nomination allocation.
