Increased minimum penalty for contraventions under the Ontario Immigration Act or its regulations
The Ontario Immigrant Nominee Program (OINP) has changed the formula used to calculate administrative monetary penalties (AMPs) for employers, representatives, and recruiters, as well as those who acquire a financial benefit for contraventions under the Ontario Immigration Act, 2015 (OIA) or its regulations. The change increases the minimum AMP amount from $2,000 to $10,000 for employers, recruiters and people or bodies that acquired a financial benefit from the offense.
For contraventions that occur on or after July 1st, 2024, the formula used to calculate AMPs is as follows:
AMP Amount = (A × B × C) + D, where,
- A = $10,000 if an employer, representative or recruiter or if the person or body acquired a financial benefit as a result of the contravention, and $2000 in any other case,
- B = the total number of administrative penalties that have been imposed against the person or body in the previous 10 years or the number 1 otherwise,
- C = the number of applicants involved if the contravention involves applications of multiple persons or bodies or the number 1 otherwise, and
- D = the monetary amount that the person or body has received at any time in connection with the contravention.

Program Update – Employers with Mobile Workers
Please note that the Ontario Immigrant Nominee Program (OINP) has updated its Employer Guide and related Employer Job Offer stream pages to clarify the minimum number of employees that an employer must have when the employer employs mobile workers. This includes, as an example, employers in the construction industry with workers who work at more than one “job” location.
The updated OINP guidance makes it clear that when an employer employs a mobile workforce, the minimum number of employees the employer must have at the location where the applicant will work or report to work can include both:
- employees who work at that location
- employees who report to work at that location
“Report to work” location means either:
- the location where the applicant’s immediate supervisor or manager works, or
- the location of the administrative office where the applicant will receive work assignments
The minimum number of employees for the report to work location remains 5 if the applicant will report to work at a location in the Greater Toronto Area, and 3 if the applicant will report to work at a location outside the Greater Toronto Area.

Immigration is a shared responsibility between the federal government and provinces and territories.
The Ontario Immigrant Nominee Program (OINP) is Ontario’s immigration selection program. Ontario complements the federal government’s immigration programs through programs like OINP, which selects workers who can fill positions that are difficult to fill through local labour markets in priority areas such as healthcare, specialized skilled trades, and technology. The program’s ability to nominate francophones in 2023 was significantly impacted by the federal government’s new Category-Based Selection initiative, which included targeted rounds of invitations issued to francophone immigrants in the express entry system, many of whom would have otherwise applied to the OINP.
Ontario expects to benefit significantly from the federal government’s Category-Based Selection initiative, as many federally-selected francophones will choose Ontario as their intended destination.
The OINP remains committed to optimizing the number of francophones nominated through the program and will continue its efforts to promote the OINP and Ontario as a destination of choice to francophones.
In 2023, the program issued three nominations under its Entrepreneur Stream. By the end of the year, 53 additional applicants were in the stream’s compliance monitoring process actively running their businesses in Ontario. Since the stream was launched in 2016, 8 entrepreneurs have been nominated.
OINP nominees in 2023 came from over 155 different countries with the highest number of nominations made to applicants from India, China and Nigeria.
Country of birth | Number of nominations |
---|---|
India | 8,603 |
China | 2,855 |
Nigeria | 799 |
Iran | 665 |
Pakistan | 390 |
Philippines | 337 |
Bangladesh | 266 |
Brazil | 210 |
SouthKorea | 147 |
Portugal | 111 |
All other countries | 1,942 |

New requirement for all applications – Applicant Consent Form
As of February 26, 2024, all new applications for an Ontario Immigrant Nominee Program (OINP) nomination must include the Applicant Consent Form. The form must be:
- completed
- correctly dated
- signed by the applicant
- signed by the applicant’s spouse and dependents, if applicable
- uploaded with other documents in the application
If the form is not completed correctly, your application will be returned as incomplete and your fee will be refunded.
If you have a representative, they cannot not sign this form on your behalf.
You must complete this form after you have received an invitation to apply, or a notification of interest.
We no longer require the PDF Attestation Form for applications made under an OINP expression of interest system stream.
We have updated program materials and website pages to reflect the addition of the Applicant Consent Form.
If you are applying to the OINP, please carefully review stream specific document checklist to ensure you submit all mandatory documents.
Change to Eligible Tests for English Language Proficiency
Consistent with recent changes to federal policy, the OINP will also be accepting the Pearson Test of English (PTE) Core from Pearson Canada, Inc. as demonstration of English proficiency for all OINP streams that require proof of English language proficiency and for OINP Expression of Interest (EOI) points claims. The PTE will be an additional test that applicants may submit to the program to demonstrate their language ability.
This change came into effect on January 30, 2024.
If you have registered an EOI and have not received an Invitation to Apply (ITA), you may want to update your EOI if you have taken the PTE.
This program change will not impact individuals who received an ITA or Notification of Interest from the OINP prior to January 30, 2024.
Program materials and website pages have been updated to reflect this update.

Eligibility changes for international students with a job offer
The regulations that govern the OINP have been amended to expand eligibility for international students. These changes include expanding eligibility to students who have obtained a one-year Ontario College Graduate Certificate.
Previously, the OINP’s Employer Job Offer: International Student stream allowed candidates to apply with a one-year credential from an eligible institution only if the program required the completion of a degree as an admission requirement.
With these amendments, applicants who have completed a qualifying one-year college program resulting in an Ontario College Graduate Certificate qualify.
The amendments came into effect on January 1st, 2024 and do not impact previously processed applications.
Prior to January 1, 2024 | Effective January 1, 2024 | |
---|---|---|
Program requirement | Students who obtained a one-year certificate from an Ontario college were only eligible if their program required a degree for admission. | Students who obtain an Ontario College Graduate Certificate are eligible. |
Program eligibility | Most one-year certificate programs were ineligible. | Many one-year certificate programs in Ontario are eligible. |
For details, please see the Employer Job Offer: International Student stream pages and Ontario’s e-Laws website: O. Reg. 422/17: General.
To align with this change, the Expression of Interest (EOI) scoring factors for additional Canadian educational credentials and highest educational credential have been revised. Current registrants who have not been invited to apply are encouraged to review the changes to these EOI scoring factors and may wish to update their EOI accordingly.
Revisions have also been made to the list of eligible Canadian and Ontario institutions for this stream.
We encourage potential applicants to review the Employer Job Offer: International Student stream requirements and EOI scoring factors before they apply to ensure they meet all stream criteria.
