Declaration Order

The Ministry of the Environment (MOE) Declaration Order 41/2 came into force on December 10, 2005 and exempts the MOE from the requirements to prepare an individual environmental assessment under the Environmental Assessment Act (EAA) when undertaking clean up and/or remedial activities, as would otherwise be required without this exemption. The activities undertaken by the MOE under Declaration Order 41/2 are in the interest of the people of Ontario because they are related to clean-up and/or remedial work, which if left undone may pose risk or danger to the health or safety of any person; result in impairment or serious risk of impairment of the quality of the natural environment for any use that can be made of it; or cause injury or damage or serious risk of injury or damage to any property or to any plant or animal life.

Declaration Order 41/2 is an important tool that allows MOE to act quickly in an emergency situation, safeguarding human health and protecting the environment. Condition two of Declaration Order 41/2 states that the Environmental Assessment and Approvals Branch (EAAB) shall provide notification of the MOE’s activities to the public. The EAAB, through this posting, is providing a five year summary of the MOE’s remediation activities under Declaration Order 41/2 for the years 2005-2010. These activities may have been deemed necessary under the Environmental Protection Act, Safe Drinking Water Act, Ontario Water Resources Act, Pesticides Act or Nutrient Management Act or because the MOE determines it is necessary to do work under the Declaration Order 41/2.
