s. 49 (1) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the issuance of an administrative penalty for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

Description
s. 8 (1) of the Act, prohibition against offering or providing a vocational program for a fee unless the person is registered, and the provision of the vocational program has been approved by the Superintendent.
Under O.Reg. 415/06 s.51, the penalty for the first contravention of s.8 (1) is $1,000 per day.

Review decision
The balance of evidence indicates that despite the progressive enforcement measures administrated by the Office of the Superintendent of Career Colleges, including the Caution Letter dated January 5, 2021, the Restraining Order, and the Notice of Contravention issued on October 3, 2022, [the Business]:
- Offered or provided a Hairdressing and Barbering Program for a fee without being registered under the Act or having the provision of the vocational program approved by the Superintendent, thus contravening s. 8 (1) of the Act.
However, in consideration of [the Business’] efforts to comply with the Act, the penalty has been reduced from $1,000 to $200.

On receipt of the Notice of Contravention on October 3, 2022, the Royal School of Hairdressing & Barbering took immediate corrective action and stopped contravening the Act. In the time since the issuance of the Notice of Contravention, Royal School of Hairdressing & Barbering has been registered as a Career College and obtained approval of the Superintendent to offer a vocational program.
