Order in Council 108/2026
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas:
- Ontario Regulation 304/04 made under the Development Corporations Act provides that the Walkerton Clean Water Centre (“Centre”) shall not, except with the approval of the Lieutenant Governor in Council, acquire, hold or dispose of any interest in land, however and despite the foregoing, the Centre, without the approval of the Lieutenant Governor in Council, may lease land for its own use if the cost is less than $1,000,000 over the term of the lease and may dispose of, transfer or otherwise deal with such a leasehold interest;
- The Centre and Ontario Infrastructure and Lands Corporation, as representative of the Minister of Government and Consumer Services, as representative of Her Majesty the Queen in right of Ontario (“IO”) entered into a Space User Agreement for Provincial Crown Agencies, dated as of December 30, 2021, effective as of July 1, 2021 (the “Original SUA”), for the Centre’s use of premises, buildings and/or lands at 20 Ontario Road, Walkerton, Ontario N0G 2V0;
- The value of the Space User Agreement will reach or exceed $1,000,000 in 2026;
- As authorized, ratified, and confirmed by The Corporation of the Municipality of Brockton By-Law 2021-127, cited as the “Infrastructure Ontario Agreement of Purchase and Sale By-Law”, property located in the East Ridge Business Park in Walkerton, Ontario, described in PIN 33196-0469 (LT), being Part of Lot 35 Concession 1, North of Durham Road Geographic Township of Brant designated as Parts 3, 4 and 5 on Reference Plan 3R-8873; Municipality of Brockton, Country of Bruce, was sold to Her Majesty the Queen in right of Ontario as represented by the Minister of Government and Consumer Services as represented by Ontario Infrastructure and Lands Corporation;
- The property referred to in the Infrastructure Ontario Agreement of Purchase and Sale By-Law is located adjacent to the Centre’s premises in Walkerton (the “Expansion Premises”). IO and the Centre have agreed that the Expansion Premises could be occupied by the Centre and, to effect such an agreement, an amendment to the Original SUA is required;
Now therefore:
- The Lieutenant Governor in Council hereby approves the Original SUA for the initial term to June 30, 2031, as well as the two extension terms of five years each to a potential full term of up to June 30, 2041;
- The Lieutenant Governor in Council hereby approves the amendment to the Original SUA to include the Expansion Premises.
