Order in Council 1526/2025

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas The Niagara Parks Commission is the owner of the lands identified in Schedule “A” (the “Niagara Parks’ Lands”);

And whereas The Corporation of the City of Niagara Falls is the owner of the lands identified in Schedule “B” (the “City’s Lands”);

And whereas subsection 7(1) of the Niagara Parks Act authorizes The Niagara Parks Commission to acquire by purchase, lease or otherwise any land or any interest in land and to sell or otherwise dispose of any land or any interest in land, subject to the approval of the Lieutenant Governor in Council;

And whereas, pursuant to a Land Exchange Agreement dated December 7, 2023, The Niagara Parks Commission agreed to acquire from The Corporation of the City of Niagara Falls for nominal consideration the City’s Lands and The Niagara Parks Commission agreed to sell to The Corporation of the City of Niagara Falls for nominal consideration the Niagara Parks’ Lands, subject to the approval of the Lieutenant Governor in Council;

Now therefore, pursuant to subsection 7(1) of the Niagara Parks Act, approval is hereby given to The Niagara Parks Commission to:

1. acquire from The Corporation of the City of Niagara Falls for nominal consideration the City’s Lands;
2. sell to The Corporation of the City of Niagara Falls for nominal consideration the Niagara Parks’ Lands; and
3. execute such documents as may be necessary for that purpose.
