On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Delegation of Powers Pursuant to Subsection 7.0.4 (1) of the Emergency Management and Civil Protection Act

Closure of Places of Non-Essential Business

Whereas an emergency has been declared pursuant to Order in Council 518/2020 (Ontario Regulation 50/20) on March 17, 2020 at 7:30 a.m. Toronto time pursuant to subsection 7.0.1 (1) of the Emergency Management and Civil Protection Act (the “Act”);

And whereas an Order respecting the closure of places of non-essential business has been made pursuant to Order in Council 65/2020 (Ontario Regulation 82/20, the “Regulation”) on March 24, 2020 at 6:15 p.m. Toronto time pursuant to paragraphs 5 and 14 of subsection 7.0.2 (4) of the Act;

And whereas it may be necessary to make further Orders amending that Regulation or to make further orders respecting the closure of places of non-essential business;

Now therefore, the following Order is made pursuant to subsection 7.0.4 (1) of the Act;

  1. The powers of the Lieutenant Governor in Council under subsection 7.0.2 (4) of the Act respecting the closure of places of non-essential business, including the power to amend any regulations made under the Act pursuant to that authority, and the power to make an Order under subsection 7.0.2 (4) of the Act retroactive to a date specified in the Order, pursuant to clause 7.2 (1) (b) of the Act, are hereby delegated to the following Ministers of the Crown:
    1. The Attorney General
    2. The Minister of Health
    3. The Solicitor General
    4. The Minister of Economic Development, Job Creation and Trade
    5. The Associate Minister of Small Business and Red Tape Reduction – Ministry of Economic Development, Job Creation and Trade
    6. The Minister of Labour, Training and Skills Development
  1. The delegation set out in paragraph 1 of this Order is subject to the following conditions:
    1. An Order may be made by one of the Ministers of the Crown listed in paragraph 1.
    2. Before making an Order, a Minister shall obtain the agreement of at least two other Ministers of the Crown listed in paragraph 1.
