On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas Centralized Supply Chain Ontario (“Supply Ontario”) is a corporation without share capital established pursuant to Ontario Regulation 612/20 (Centralized Supply Chain Ontario) under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019;

And whereas Supply Ontario is an agent of the Crown for all purposes;

And whereas the Lieutenant Governor in Council considers it reasonable and appropriate for eligible employees of Supply Ontario to participate in the Public Service Pension Plan (“PSPP”) and the Public Service Supplementary Benefits Account (“PSSBA”);

And whereas the Crown is requesting that Supply Ontario indemnify the Crown against any and all liabilities incurred in connection with Supply Ontario’s participation as an employer under the PSPP and the PSSBA;

And whereas pursuant to paragraph 3 of subsection 4(3) of Ontario Regulation 612/20 under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019, Supply Ontario requires the approval of the Lieutenant Governor in Council to indemnify any person from liability or guarantee the payment of money or the performance of services by another person;

And whereas it is considered desirable to authorize Supply Ontario to indemnify the Crown against liabilities incurred in connection with its participation as an employer under the PSPP and PSSBA;

Now therefore pursuant to paragraph 3 of subsection 4(3) of Ontario Regulation 612/20 under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019, approval is hereby given to Supply Ontario to indemnify the Crown against any and all liabilities incurred in connection with Supply Ontario’s participation as an employer under the PSPP and the PSSBA in respect of the period on and after March 1, 2021.
