
Order in Council 628/2021
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas pursuant to section 7 of the Crown Forest Sustainability Act, 1994, S.O. 1994, c. 25 (“CFSA”), the then Minister of Natural Resources designated the management unit currently known as the Kenogami Forest (the “Kenogami Forest Management Unit”) effective as of April 1, 1998;
And whereas pursuant to section 26 of the CFSA, the Minister of Natural Resources and Forestry (the “Minister”) may, with the approval of the Lieutenant Governor in Council, grant a renewable licence to harvest forest resources in a management unit for a term of up to 20 years, which requires the licensee to carry out renewal and maintenance activities for the benefit and on behalf of the Crown necessary to provide for the sustainability of the Crown forest in the area covered by the licence (an “SFL”);
And whereas Ne-Daa-Kii-Me-Naan Inc., a corporation owned by First Nations that were involved in establishing Ogwiidachiwaning Sustainable Forest Management Inc. (“OSFMI”), currently manages the Kenogami Forest Management Unit under Forest Resource Licence No. 553950 granted pursuant to section 27 of the CFSA that came into effect on December 21, 2018 and expires on March 31, 2022 (the “FRL”);
And whereas OSFMI was established as a corporation without share capital on October 21, 2020 and one of OSFMI’s objects is to manage the Kenogami Forest in a manner that provides for the long term forest sustainability in accordance with the CFSA;
And whereas OSFMI wants to carry out its objects and the Minister wants to grant to OSFMI an SFL covering the Kenogami Forest Management Unit for a term of up to 20 years;
Now therefore, pursuant to subsection 26(1) of the CFSA, the Minister is hereby given approval to grant to OSFMI an SFL substantially in the form of SFL 554576 for a term of up to 20 years, expiring on March 31, 2041, covering the Kenogami Forest Management Unit.
