Minister’s Order

Whereas the Program was established by the Previous Order pursuant to section 6.2 of the Ministry of Agriculture, Food and Rural Affairs Act for the encouragement of agriculture, food and agribusiness;

And whereas sections 49 and 54 of the Legislation Act, 2006 has the effect of providing the Minister with the power to amend, revoke or replace from time to time an order issued under section 6.2 of the Ministry of Agriculture, Food and Rural Affairs Act;

And whereas I, the Minister of Agriculture, Food and Agribusiness, wish to make amendments to the Previous Order.

Now therefore, and pursuant to my authority under section 6.2(1) of the Ministry of Agriculture, Food and Rural Affairs Act and sections 49 and 54 of the Legislation Act, 2006, I hereby order the Previous Order be amended as set out in this Minister’s Order.

Part 1 — Interpretation of this Order

  1. (1) For the purposes of this Minister’s Order, the following terms will have the following meanings:

    • “Minister’s Order” means this Minister’s Order, as it may be amended from time to time.
    • “Previous Order” means Minister’s Order 0001/2025, which continued the Program.
    • “Program” means the Ontario Wine Fund Program, as established by the Previous Order.

    (2) Any capitalized term not defined within this Minister’s Order will have the same meaning as set out under the Previous Order.

Part 2 — General Amendments to Previous Order

  1. The Previous Order is amended by adding the French translation to it, as set out under the Appendix to this Minister’s Order.

Part 3 — Amendments to Part II — Term of the Previous Order

  1. Section 6 of the Previous Order is revoked and replaced with the following:
  1. Despite anything else in this Order, the Program will automatically terminate in the event the Program Administrator is of the opinion there is an insufficient appropriation from the Ontario Legislature or insufficient funding in the budget for the Program for any payment that is to be made under the Program. Where the Program is terminated pursuant to this section 6 of this Order, the following rules will apply:
    1. The Program Administrator will post, or cause to be posted, a notice on the Ministry’s website where a copy of this Order is posted setting out the Program has been terminated and the date the Program was terminated;
    2. The Program Administrator will immediately provide notice, or cause notice to be immediately provided, of the termination to any Administrator delivering all or a part of an Initiative and cause that Administrator to post a notice on its website setting out the Program has been terminated and the date the Program was terminated;
    3. All Initiatives under the Program will terminate as of the date set out under section 6(a) of this Order; and
    4. Any payments under the Program for which there is no appropriation will not be paid.

This Minister’s Order comes into force and effect on the date it is signed.
