Notice Of Extension Of Ministry Of Northern Development And Mines Declaration Order Mndm- 3 (O. Reg. 1266/03) For Disposition Of Certain Or All RIGHTS TO CROWN RESOURCES

RE: Disposition of Certain or all Rights to Crown Resources Proponent: Ministry of Northern Development and Mines

The Declaration Order for the disposition of certain or all rights to Crown resources was approved on the 11th day of June 2003, by Order in Council No. 1266/03. Condition 17 of this approval provides that the Declaration Order shall expire on June 11, 2004 or may be ex- tended to such later date as is determined by the Minister of the Envi- ronment and published in the Ontario Gazette.

Take Notice that the above Declaration Order has been extended for a period of two years to provide time for the Ministry of Northern Development and Mines to obtain long-term approval under the Environmental Assessment Act for the disposition of certain or all rights to Crown resources. The Declaration Order shall now terminate on June 11, 2006. This does not affect the possibility of future extensions under Condition 17 of the Declaration Order.

As the Ministry of Northern Development and Mines intends to incorporate the requirements of Condition 14 of the Declaration Order in the long-term approval, Condition 14, in effect, now reads:

14. “By June 11, 2006, the Ministry of Northern Development and Mines shall develop, with the Ministry of Culture, a Memorandum of Understanding to address the mitigation of impacts to cultural heritage resources.”

As the Ministry of Northern Development and Mines has fulfilled Condition 18 of the Order, Condition 18, in effect, now reads:

18. “Within two months of the approval of this Order, a Final Strategy for Environmental Assessment Coverage (Strategy) shall be sub- mitted that includes all of the Ministry of Northern Development and Mines’ activities that are subject to the Environmental Assessment Act and a timetable for implementation of the Strategy that is acceptable to the Director of the Environmental Assessment and Approvals Branch.

The Ministry of Northern Development and Mines shall report, in writing, to the Director of the Environmental Assessment and Approvals Branch with respect to the progress made on the Strategy every six months until the Strategy is implemented.

Any request for an extension to this Order shall be made at least six months prior to the expiration of this Order and accompanied by a detailed work plan for completing the implementation of the recommendations of the Strategy.”

Also effective July 1, 2004, the rate of interest will be 4% on amounts refunded or credited after an objection or appeal of Commercial Concentration Tax, Corporations Tax, Employer Health Tax, Gasoline Tax*, Fuel Tax*, Land Transfer Tax, Mining Tax, Retail Sales Tax, Tobacco Tax or Electricity Act payments. Under retroactive regulation changes that came into force in September 1999, the rate of interest on amounts refunded or credited after successful objections or appeals is increased by two points over the general rate on refunds, applicable to periods after 1998 for Commercial Concentration Tax, Gasoline Tax, Fuel Tax, Land Transfer Tax, Retail Sales Tax, and Tobacco Tax, and to taxation years ending after 1997 for Corporations Tax, Employer Health Tax, Mining Tax and Electricity Act payments.

* The rates in this Notice do not apply to International Fuel Tax Agreement (Ifta) matters, as that agreement contains distinct provisions for setting interest rates.

Notice Of Proposed Regulations

Personal Health Information Protection Act, 2004 and the Quality of Care Information Protection Act, 2004

The Minister of Health and Long-Term Care on behalf of the Government of Ontario invites public comments on regulations proposed to be made under the Personal Health Information Protection Act, 2004 and the Quality of Care Information Protection Act, 2004.

The Health Information Protection Act, 2004, which included the Personal Health Information Protection Act, 2004 and the Quality of Care Information Protection Act, 2004 as schedules, was passed unanimously by the Legislature and received Royal Assent on May 20, 2004. Before the latter two Acts come into force on November 1, 2004, the Government is considering the development of regulations to accompany them. Both Acts require that the Minister publish a notice of the proposed regulations and allow 60 days for public comment, after which

the Minister reports to the Lieutenant Governor in Council, who may then finalize the regulation with or without changes.

Proposed Regulation under the Personal Health Information Protection Act, 2004

The regulation proposed to be made under the Personal Health Information Protection Act, 2004 includes the following:

  • Defining expressions used within the definition of “health care” in the Act, which affects the application of various provisions of the Act, to clarify that
    1. taking blood donations is considered health care, and
    2. the assessment of an individual’s health for the purposes of a proceeding or claim is considered health care [s. 1(1) of draft regulation]
  • Excluding from the scope of “marketing”, regulated under s.33 of the Act,
    1. blood donor recruitment by Canadian Blood Services
    2. solicitations for block fees by a health care practitioner for non- Ohip covered charges [s. 1(2) of draft regulation]
  • Clarifying the definition of “disclose” so that it does not include providing information directly back to the person who provided it in the first place [s. 1(3) of draft regulation]
  • Clarifying that where the Act provides for a discretionary disclosure, etc. and another act prohibits the disclosure, etc., there is considered to be a conflict such that PHIPA prevails unless specifically provided otherwise. [s. 1(4) of draft regulation]
  • Excluding persons providing fitness or weight-management services from the scope of a person who is considered a “health care practitioner” since the person’s “primary function is to provide health care for payment” [s. 2 of draft regulation]
  • Designating Canadian Blood Services as a health information custodian, and authorizing it to function as a single health information custodian with respect to all of its functions [s.3(1) of draft regulation]
  • Allowing registries that are prescribed under clause 39(1)(c), and entities prescribed under s.45 to act as health information custodians for the purpose of provisions that allow a health information custodian to use or disclose information for research purposes with research ethics board (Reb) approval in certain circumstances [s.3(2) of draft regulation]
  • Clarifying that a board of health and the medical officer of health associated with it function as one health information custodian for the purposes of the Act [s.3(3) of draft regulation]
  • Clarifying that information in a mixed record (containing both personal health information and non-health personal information) is all considered to be personal health information for the purpose of the application of the Act [s.4 of draft regulation]
  • Ensuring that the confidentiality provisions in subsection 19(8) of the Remedies for Organized Crime and Other Unlawful Activities Act, 2001 are not overridden by the disclosure provisions in the Act [s. 5 of draft regulation]
  • Setting requirements [s. 6 of draft regulation] for persons who supply goods or services for the purpose of enabling a health infor- mation custodian to use electronic means to collect, use, modify, disclose, retain or dispose of personal health information, includ- ing:
    • restrictions on the use and disclosure of the personal health information by any person who is not an agent and who sup- plies services to the custodian for such a purpose
    • requirements on health information network providers includ- ing requirements to
      • notify the custodian in case of any breaches, perform risk and privacy assessments,
      • enter into a written agreement with the custodian,
      • provide an audit trail, and
      • make publicly available information about the provider’s services to the custodian
  • Allowing Canadian Medical Protective Association and the Healthcare Insurance Reciprocal of Canada to use personal health information for systemic risk management analysis [s. 7 of draft regulation]
  • Specifying that an application to appoint or challenge a substitute decision-maker before the Consent and Capacity Board automati- cally enables the Board to rule on the capacity of the individual for whom the decisions are being made, as in the Health Care Consent Act [s. 8 of draft regulation]
  • Specifying [in s. 9 of draft regulation] that only the individual’s mailing address can be provided with the individual’s name for fundraising purposes based on implied consent, and providing the following further restrictions on the collection, use or disclosure of personal health information for fundraising:
    • it is permitted only where the fundraising relates to a charitable or philanthropic purpose related to the custodian’s functions
    • implied consent can only be inferred where the individual had notice, posted or made available at the time of receiving service, of the custodian’s intention to use or disclose such information for fundraising purposes, together with information on how to easily opt out
    • no solicitation can be made within 60 days after the individual was discharged or received service
    • all solicitations must contain easy opt-out from any further so- licitations
    • solicitations may not contain information about the individual’s health or health care
  • Setting out provisions relating to the regulation under s.34 of the Act of the collection, use and disclosure of health numbers includ- ing:
    • clarifying that provisions regulating the use and disclosure of health numbers by a person who is not a health information custodian do not apply to an agent acting on behalf of a health information custodian [s. 1(5) of draft regulation]
    • exempting the Workplace Safety and Insurance Board from the prohibition on non-health information custodians collecting or using health numbers [s. 10 of draft regulation]
    • allowing non-health information custodians to disclose a health number to facilitate the provision of provincially funded health resources [s. 11(1) of draft regulation]
    • allowing researchers to disclose a health number to another researcher or to a registry or s. 45 prescribed entity if the disclo- sure is either part of a research plan approved by a research
    • ethics board under the Act or if it is necessary for the purpose of verifying or validating the information held by the researcher [s. 11(2) of draft regulation]
  • Setting out [in s. 12 of draft regulation] requirements for registries under clause 39(1)(c) of the Act, including that such registries must make publicly available:
    • a plain language description of the functions of the registry, including how personal health information is collected, used and disclosed by the registry
    • general information on measures to protect security and confi- dentiality
    • copies of risk and privacy assessments

    [Note: At present no such registries are prescribed. See below for more information.]

  • Setting out requirements that must be met by research ethics boards [s. 13 of draft regulation]
  • Setting out additional requirements for research plans for the pur- poses on subsection 44(2) of the Act [s. 14 of draft regulation]
  • Allowing researchers to disclose personal health information to an- other researcher or to a registry or s. 45 prescribed entity if the disclosure is either part of a research plan approved by a research ethics board under the Act or if it is necessary for the purpose of verifying or validating the information held by the researcher [s. 15 of draft regulation]
  • Prescribing various entities for the purposes on s.45(1) of the Act [s. 16 of draft regulation]
  • Providing that an institution subject to either of Ontario’s public sector privacy acts may collect information from a health informa- tion custodian if and only if the custodian has authority to disclose the information to the institution [s. 17 of draft regulation]
  • Exempting children’s aid societies, foster parents, and health sector regulatory colleges from the restrictions on use and disclose of personal health information set out in subsection 49(2) of the Act [s.18 of draft regulation]
  • The Canadian Institute for Health Information (Cihi) is prescribed under s.50(1)(d) as the agency authorized to disclose personal health information to other provincial governments concerning the treat- ment of their residents in Ontario, for health planning and adminis- tration purposes, enabling Cihi to continue functioning in this ca- pacity [s. 19 of draft regulation]
  • The following types of personal health information are exempted [under s. 20 of draft regulation] from the access and correction provisions of the Act
    • information that a researcher holds solely for research con- ducted under the Act
    • information held by a medical laboratory as the result of a health information custodian’s requesting the laboratory to per- form a test, where the individual will have access to the informa- tion through the custodian, unless the custodian directs the labo- ratory to provide access directly
  • Certain special rules are prescribed with respect to the collection, use or disclosure of personal health information by Canadian Blood Services [s. 21 of draft regulation]

    As noted above, in the current draft no registries are being prescribed under s.39(1)(c), since the Ministry does not yet have all the informa- tion required to determine with certainty that such designation would be necessary and appropriate. We are asking that any persons who may wish to be prescribed under s.39(1)(c) make a request to that effect to the Ministry setting out information addressing the following criteria, and any other information the person considers relevant:

    1. Do the objects of the Registry include the collection of personal health information for the purpose of facilitating or improvingthe provision of health care, or the storage or donation of body parts or bodily substances? Please give details.
    2. Under what legal authority does the Registry currently collect, use and/or disclose personal health information, and how will that change when the Personal Health Information Protection Act, 2004 comes into force?
    3. Is the Registry located and operating in Ontario for the benefit of the people of Ontario?
    4. Was the Registry established pursuant to a request or direction of the Government of Ontario?
    5. Can the Registry function without being prescribed under s. 39(1)(c) the Personal Health Information Protection Act, 2004? Can the functions of the Registry be performed without personal health information? Why is consent not being ob- tained?
    6. What is the past and current performance of the Registry in respect to appropriate secure and privacy-protective informa- tion practices?
    7. Have there been any views expressed by the Information and Privacy Commissioner regarding the Registry?

Proposed Regulations under the Quality of Care Information Protection Act, 2004

The regulations proposed to be made under the Quality of Care Information Protection Act, 2004 would:

  • prescribe as additional entities that can establish a quality of care committee,
    • long-tem care facilities (including nursing homes, and charita- ble or municipal homes for the aged),
    • medical laboratories, and
    • the Ontario Medical Association in respect of its oversight role for medical laboratories
    [ss. 1 and 2 of draft regulation under Quality of Care Information Protection Act, 2004 on the “Definition of “Quality of Care Committee”]
  • set criteria that all quality of care committees must meet, including that the committee must:
    • be designated as such in writing, with the designation and terms of reference being made publicly available
    • function solely or primary for quality of care purposes, and not be engaged in functions required by statutes other than the Independent Health Facilities Act or the Laboratory and Specimen Collection Centre Licensing Act
    [s. 3 of draft regulation under Quality of Care Information Protec- tion Act, 2004 on the “Definition of “Quality of Care Committee”]
  • specify provisions of other legislation, particularly the Independent Health Facilities Act and the Laboratory and Specimen Collection Centre Licensing Act, that prevail over the Act [s. 1 of draft “Gen- eral” regulation under Quality of Care Information Protection Act, 2004]

Invitation to Provide Comments on Proposed Regulations
The public is invited to provide written comments on the draft regula- tions over a 60 day period, commencing on July 3, 2004 and ending on September 3, 2004.

In providing comments, please consider whether the proposed provisions should be included in the final regulations, with or without changes. Furthermore, please consider whether any other provisions should be included in the regulations. Please be as specific as possible, and pro- vide a full rationale for any suggested changes or additions.

Proposed Regulation under the Personal Health Information Protection Act, 2004

General

Definitions for the purposes of the Act

    1. In the definition of “health care” in the Act,

      “a procedure that is done for a health-related purpose” includes taking a donation of blood or blood products from an individual;

      “health-related purpose” includes the purpose of assessing the health of an individual for the purposes of a proceeding or claim

    2. For the purposes of the Act,

      “marketing” does not include

      1. a communication by a health care practitioner who provides insured services within the meaning of the Health Insurance Act to an individual or a member of the individual’s family or household by which the practitioner makes available to those persons an arrangement whereby they may receive ancillary uninsured services for a block fee or on the basis of a set fee for service; or
      2. a communication by the Canadian Blood Services for the purpose of recruiting donors of blood or blood products.
    3. In the definition of “disclose” in section 2 of the Act, the expres- sion “to make the information available or to release it to another health information custodian or to another person” does not include a per- son’s providing personal health information to someone who provided it to or disclosed it to the person, whether or not the personal health information has been manipulated or altered, if it does not contain any additional identifying information.
    4. For the purposes of subsection 7 (3) of the Act, if the Act or its regulations provides that an action, including a collection, use or dis- closure, may be taken, and another Act or regulation provides that it may not be taken, then “it is not possible to comply with both”.
    5. For the purposes of subsections 34 (2) and (3) of the Act,

      “a person who is not a health information custodian” does not include a custodian’s agent who is using or disclosing the information on behalf of the custodian in accordance with the Act.

Exemptions, “health care practitioner”

  1. The following persons are not health care practitioners under clause (d) of the definition of “health care practitioner” in the Act:
    1. Persons providing fitness or weight-management counselling or services

Health information custodians

    1. The Canadian Blood Services is prescribed as a health information custodian, and is prescribed as a single health information custodian with respect to all its functions.
    2. The following are prescribed as health information custodians only for the purposes of clause 37 (1) (j), subsection 37 (2) and section 44 of the Act:
      1. Every entity that is a prescribed entity for the purposes of sub- section 45 (1) of the Act.
      2. Every person that is a prescribed person for the purposes of clause 39 (1) (c) of the Act.
    3. A medical officer of health within the meaning of the Health Protection and Promotion Act, together with the board of health with which the medical officer of health is associated, are prescribed as a single health information custodian with respect to all of their func- tions.

Mixed records

  1. Except for the purposes of subsection 8 (4) of the Act, “personal health information” as defined under subsection 4 (1) of the Act in- cludes all identifying information that is contained in a record that contains information of the type referred to in any one or more of clauses (a) to (g) of subsection 4 (1).

Prevail over Act

  1. confidentiality requirements in the following provisions prevail over the Act:
    1. Subsection 19 (8) of the Remedies for Organized Crime and Other Unlawful Activities Act, 2001.

Persons who provide to custodians

    1. Except as otherwise required by law, the following are pre- scribed as requirements for the purposes of subsection 10 (4) of the Act with respect to a person who supplies services for the purpose of enabling a health information custodian to use electronic means to collect, use, modify, disclose, retain or dispose of personal health information, and who is not an agent of the custodian:
      1. The person shall not use any personal health information to which it has access in the course of providing the services for the health information custodian except as necessary in the course of providing repair or maintenance services.
      2. The person shall not disclose any personal health information to which it has access in the course of providing the services for the health information custodian.
    2. The following are prescribed as requirements with respect to a health information network provider:
      1. The provider shall notify every applicable health information custodian at the first reasonable opportunity if,
        1. the provider accessed, used, disclosed or disposed of personal health information other than in accordance with paragraphs 1 and 2 of subsection (1), or
        2. an unauthorized person accessed the personal health information.
      2. The provider shall provide to each applicable health information custodian a plain language description of the services that the provider provides to the custodians, that is appropriate for sharing with the individuals to whom the personal health information relates, including a description of the safeguards in place to protect against unauthorized use and disclosure, and to protect the integrity of the information.
      3. The provider shall make available to the public,
        1. the description referred to in paragraph 2,
        2. any directives, guidelines, and policies of the provider that apply to the services that the provider provides to the health information custodians to the extent that these do not reveal a trade secret or confidential scientific, technical, commercial or labour relations information; and
        3. a general description of the safeguards implemented by the person in relation to the security and confidentiality of the information.
      4. The provider shall make available to each applicable health information custodian an electronic record of all uses and dis- closures of and access to the personal health information, including the time when the information was accessed and by whom.
      5. The provider shall perform, and provide to each applicable health information custodian a written copy of the results of, an assessment of the services provided to the health information custodians, with respect to,
        1. threats, vulnerabilities and risks to the security and integrity of the personal health information, and
        2. how the services may affect the privacy of the individuals who are the subject of the information.
      6. The provider shall ensure that any contractor it retains agrees to comply with the same restrictions and conditions that apply to the Provider
      7. The provider shall enter into a written agreement with each health information custodian concerning the services provided to the custodian, that
        1. describes the services that the provider is required to pro- vide for the custodian,
        2. describes the administrative, technical and physical safe- guards relating to the confidentiality and security of the information, and
        3. requires the provider to comply with the Act and the regulations
    3. A health information custodian who uses goods or services sup- plied by a person referred to in subsection 10 (4) of the Act, other than a person who is an agent of the custodian, for the purpose of using electronic means to collect, use, modify, disclose, retain or dispose of personal health information shall not be considered in so doing to make the information available or to release it to that person for the purposes of the definition of “disclose” in section 2 of the Act, if,
      1. the person complies with subsections (1) and (2), to the extent that either is applicable, in supplying services; and
      2. in the case of a person supplying goods to the health information custodian, the custodian does not, in returning the goods to the person, enable the person to access the personal health information except where subsection (1) applies and is complied with.
    4. In subsection (2),

      “health information network provider” or “provider” means a per- son who provides services to two or more health information custodians where the services are provided primarily to custodians to enable the custodians to use electronic means to disclose personal health information to one another, whether or not the person is an agent of any of the custodians.

Exception to s. 17 (2) of the Act

  1. The following is prescribed as an exception to subsection 17 (2) of the Act:
    1. An agent of a health information custodian to whom the custodian provides information to use for the purposes of clause 37(d) of the Act may use that information, together with other such information that the agent has received from other custodians to use for the purposes of that clause, for the purposes of systemic risk management analysis if,
      1. the agent is the Canadian Medical Protective Association or the Healthcare Insurance Reciprocal of Canada, and
      2. the agent does not disclose personal health information provided to it by one health information custodian to another custodian.

Substitute decision maker

  1. An application to the Board under subsection 24 (2), 27 (1) or (2) of the Act shall be deemed to include an application to the Board under subsection 22 (3) of the Act with respect to the individual’s capacity to consent to the collection, use or disclosure of his or her personal health information unless the individual’s capacity has been determined by the Board within the previous six months.

Fundraising

    1. The type of contact information that is prescribed for the purposes of clause 32 (1) (b) of the Act is the individual’s mailing address.
    2. For the purposes of subsection 32 (2) of the Act, the following are prescribed as requirements and restrictions on the manner in which consent is obtained and the resulting collection, use or disclosure of personal health information
      1. Personal health information held by a health information custo- dian may only be collected, used or disclosed for the purpose of fundraising activities undertaken for a charitable or philanthropic purpose related to the custodian’s operations.
      2. Consent under clause 32 (1) (b) of the Act may only be inferred where,
        1. the custodian has at the time of providing service to the individual, posted or made available to the individual a brief statement that unless he or she requests otherwise, his or her name and contact information may be disclosed and used for fundraising purposes on behalf of the custodian, together with information on how the individual can easily opt-out of receiving any future fundraising solicitations on behalf of the custodian, and
        2. the individual has not opted out .
      3. The individual may not be solicited for fundraising purposes relating to the operations of a custodian earlier than 60 days after discharge from a facility operated by the custodian or the provision of health care to the individual by the custodian.
      4. All solicitations for fundraising must provide the individual with an easy way to opt-out of receiving future solicitations.
      5. When contacting or attempting to contact the individual for the purpose of fundraising, the custodian or a person conducting fundraising on its behalf must not reveal any information about the individual’s health care or state of health.

Health number collection

  1. The following are prescribed persons for the purposes of clause 34 (2) (d) of the Act:
    1. The Workplace Safety and Insurance Board.

Disclosure of health number

  1. The following are prescribed as exceptions for the purposes of subsection 34 (3) of the Act:
    1. A person who is not a health information custodian may dis- close a health number for a purpose related to the provision of provincially funded health resources.
    2. A researcher who has custody or control of personal health information including a health number by reason of a disclosure authorized under section 44 of the Act, or that the re- searcher uses pursuant to clause 37 (1) (j) of the Act, may disclose the health number to a person that is a prescribed per- son for the purposes of clause 39 (1) (c) of the Act, an entity prescribed under subsection 45 (1) of the Act or another researcher if,
      1. the disclosure is part of a research plan approved under section 44 of the Act, or
      2. the disclosure is necessary for the purpose of verifying or validating the information or the research.

Registries of personal health information

    1. The following are prescribed persons for the purposes of clause 39 (1) (c) of the Act:

      Note: For the purposes of this draft regulation, no persons are prescribed here. See Minister’s Notice of Proposed Regulations for more information.

  1. A person that is a prescribed person for the purposes of clause 39 (1) (c) of the Act shall make publicly available
    1. a plain language description of the functions of the registry compiled or maintained by the person, including a description of how personal health information is collected, used and disclosed for the purposes of the registry
    2. a general description of the safeguards implemented by the person in relation to the security and confidentiality of the in- formation; and
    3. a written copy of the results of an assessment of the operations of the registry, performed by the person, with respect to,
      1. threats, vulnerabilities and risks to the security and integ- rity of the personal health information, and
      2. how the operations of the registry may affect the privacy of the individuals who are the subject of the information.
  2. person that is a prescribed person for the purposes of clause 39 (1) (c) of the Act may disclose personal health information as if it were a health information custodian for the purposes of section 45 of the Act.

Research ethics boards

  1. The following are prescribed as requirements that must be met by a research ethics board:
    1. The board must have at least five members, including,
      1. at least one member with no affiliation with the person or persons that established the research ethics board but who is recruited from a community to which the research re- lates,
      2. at least one member knowledgeable in research ethics, either as a result of formal training in research ethics, or practical or academic experience in research ethics,
      3. at least two members with expertise in the methods or in the areas of the research being considered, and
      4. at least one member with professional expertise in consid- ering personal health information privacy issues.
    2. A single member cannot fulfil the requirements in more than one category in paragraph 1.
    3. The board may only act with respect to a proposal to approve a research plan where there is no conflict of interest existing or likely to be perceived between its duty under subsection 44 (3) of the Act and the researcher’s interest in the disclosure of the personal health information or the performance of the research.

Requirements for research plans

  1. The following are prescribed as additional requirements that must be set out in research plans for the purposes of clause 44 (2) (c) of the Act:
    1. A description of the research proposed to be conducted and the duration of the research.
    2. A description of the personal health information required and the potential sources.
    3. A description of how the personal health information will be used in the research, and if it will be linked to other information, a description of the other information as well as how the linkage will be done.
    4. An explanation as to why the research cannot reasonably be accomplished without the personal health information and, if it is to be linked to other information, an explanation as to why this linkage is required.
    5. An explanation as to why consent to the disclosure of the personal health information is not being sought from the individuals to whom the information relates.
    6. A description of the reasonably foreseeable harms and benefits that may arise from the use of the personal health information and how the researchers intend to address those harms
    7. A description of all persons who will have access to the information, why their access is necessary, their roles in relation to the research, and their related qualifications.
    8. The safeguards that the researcher will impose to protect the confidentiality and security of the personal health information, including an estimate of how long information will be retained in an identifiable form and why.
    9. Information as to how and when the personal health information will be disposed of or returned to the health information custodian.
    10. The funding source of the research.
    11. Whether the researcher has applied for the approval of another research ethics board and, if so the response to or status of the application.
    12. Whether the researcher’s interest in the disclosure of the personal health information or the performance of the research would likely result in an actual, perceived or potential conflict of interest with other duties of the researcher.

Disclosure by researcher

  1. Despite clause 44 (6) (d) of the Act, a researcher may disclose the information to an entity prescribed under subsection 45 (1) of the Act, to a person prescribed for the purposes of clause 39 (1) (c) of the Act for use in a registry compiled or maintained by that person, or to another researcher if,
    1. the disclosure is part of a research plan approved under section 44 of the Act, or
    2. the disclosure is necessary for the purpose of verifying or validating the information or the research.

Prescribed entities for the purposes of s. 45 (1) of the Act

    1. The following are prescribed entities for the purposes of subsection 45 (1) of the Act:
      1. Cancer Care Ontario.
      2. Canadian Institute for Health Information.
      3. Institute for Clinical Evaluative Sciences.
      4. Pediatric Oncology Group of Ontario.
    2. An entity that is a prescribed entity for the purposes of subsection 45 (1) of the Act may disclose personal health information as if it were a health information custodian for the purposes of clause 39 (1) (c) of the Act and section 45 of the Act.

Collection by institution

  1. An institution within the meaning of the Freedom of Information and Protection of Privacy Act or the Municipal Freedom of Information and Protection of Privacy Act that is not a health information custodian may collect personal health information from a health information custodian if and only if the custodian has authority to disclose the information to the institution under the Act.

Extent of use or disclosure by recipient

  1. Subsection 49 (2) of the Act does not apply to,
    1. the regulatory activities of a College under the Regulated Health Professions Act, 1991, the College under the Social Work and Social Service Work Act, 1998 or the Board under the Drugless Practitioners Act;
    2. children’s aid society; or
    3. a foster parent.

S. 50(1) (d) of the Act

  1. The Canadian Institute for Health Information is a prescribed entity for the purposes of clause 50 (1) (d) of the Act.

Exemptions from access provisions

    1. The following types of personal health information in the custody or control of the following types of health information custodians are not subject to Part V of the Act:
      1. Personal health information that a researcher uses solely for the purposes of research, where the research is conducted in accordance with a research plan approved under subsection 44 (4) of the Act, or has been approved under clause 44 (10) (b) of the Act.
      2. Personal health information that is in the custody or control of a laboratory in respect of a test requested by a health care practitioner for the purpose of providing health care to the individual where the following conditions apply,
        1. the individual has a right of access to the information through the health care practitioner, or will have such a right when the information is provided by the laboratory to the health care practitioner within a reasonable time; and
        2. the health care practitioner has not directed the laboratory to provide the information directly to the individual.
    2. For the purposes of paragraph 2 of subsection (1),

      “laboratory” means,

      1. a laboratory or a specimen collection centre as defined in sec- tion 5 of the Laboratory and Specimen Collection Centre Li- censing Act, or
      2. a laboratory operated by a ministry of the Crown in right of Ontario.

Canadian Blood Services

    1. The Canadian Blood Services may indirectly collect personal health information about an individual who donates or attempts to donate blood or blood products, if the information is reasonably necessary to ensure the safety of the blood system and it is not reasonably possible to collect, directly from the individual,
      1. personal health information that can reasonably be relied on as accurate; or
      2. personal health information in a timely way.
    2. The Canadian Blood Services may use the personal health information of an individual who donates or attempts to donate blood or blood products for the purpose of ensuring the safety of the blood system.
    3. The Canadian Blood Services may collect personal health information from, and disclose personal health information to, Héma-Québec as necessary for the purpose of ensuring the safety of the supply of blood and blood products, where the personal health information relates to an individual who donates or attempts to donate blood or blood products
    4. The Canadian Blood Services shall not disclose personal health information for the purpose of recruiting donors of blood or blood products without the express consent of the individual, despite subsection 18 (2) of the Act.
    5. The Canadian Blood Services may disclose personal health information about a deceased individual who has received blood or blood products to a relative of the individual or the executor or administrator of the individual’s estate for the purpose of determining eligibility for compensation

Proposed Regulation under the Quality Of Care Information Protection Act, 2004

General

Prevail Over Act

    1. The Independent Health Facilities Act prevails over the Act with respect to any quality of care information collected by or prepared for a quality of care committee established, appointed or approved by an independent health facility.
    2. The Laboratory and Specimen Collection Centre Licensing Act prevails over the Act with respect to any quality of care information collected by or prepared for a quality of care committee established, approved of, or appointed by the Ontario Medical Association.

Proposed Regulation under the Quality Of Care Information Protection Act, 2004 Definition OfQuality Of Care Committee

Prescribed entity, health care provider

  1. The following are prescribed as entities for the purposes of subclause (a)(ii) of the definition of “quality of care committee” in section 1 of the Act:
    1. An approved charitable home for the aged within the meaning of the Charitable Institutions Act.
    2. A home or joint home within the meaning of the Homes for the Aged and Rest Homes Act.
    3. A nursing home within the meaning of the Nursing Homes Act.
    4. A laboratory or a specimen collection centre as defined in section 5 of the Laboratory and Specimen Collection Centre Licensing Act.

Prescribed entity, quality of care improver

  1. The following are prescribed as entities for the purposes of subclause (a)(iii) of the definition of “quality of care committee” in section 1 of the Act:
    1. The Ontario Medical Association, in respect of its activities con- cerning the services of laboratories and specimen collection centres as defined in section 5 of the Laboratory and Specimen Collection Centre Licensing Act.

Prescribed criteria

  1. The following are prescribed as criteria for the purposes of clause (b)of the definition of “quality of care committee” in section 1 of the Act:
    1. Before acting as a quality of care committee, it must be designated in writing as a quality of care committee for the purposes of the Act.
    2. The terms of reference of the committee and its designation must be available on request to members of public.
    3. The committee must be established, appointed or approved for the sole or primary purpose of improving or maintaining the quality of the health care or the level of skill, knowledge and competence of the persons who provide the health care.
    4. The committee may not be engaged in any function required under a statute other than the Independent Health Facilities Act the Laboratory and Specimen Collection Centre Licensing Act.
