Under And By Virtue Of a Writ of Seizure and Sale issued out of the Superior Court of Justice at London, Ontario, dated August 12, 2005, Court File Number 05-00079, to me directed, against the real and personal property of Gary Corwin Marsh, Defendant, at the suit of Bank of Nova Scotia, Plaintiff, I have seized and taken in execution all the right, title, interest and equity of redemption of Gary Corwin Marsh, in and to:

The subject property is a cottage lot located on mainland in the north arm of Burditt Lake with no road access. The property is approximately 3 miles from the public boat launch and approximately 50 miles northwest of Fort Frances, Ontario. The 1.2 acre lot is on a peninsula with over 200 feet of shoreline. The buildings consist of an 800 sq. ft. cottage, guest cabin, gas shed, storage shed, solar power shed, outhouse and floating dock.

All of which said right, title, interest and equity of redemption of Gary Corwin Marsh, Defendant in the said lands and tenements described above, I shall offer for sale by Public Auction subject to the conditions set out below at the Superior Court of Justice, 333 Church Street, Court room #2, Fort Frances, Ontario on Wednesday, August 30, 2006 at 10:00 a.m. Cst.

Conditions:

The purchaser to assume responsibility for all mortgages, charges, liens, outstanding taxes, and other encumbrances. No representation is made regarding the title of the land or any other matter relating to the interest to be sold. Responsibility for ascertaining these matters rests with the potential purchaser(s).

Terms:

  • Deposit 10% of bid price or $1,000.00, whichever is greater
  • Payable at time of sale by successful bidder
  • To be applied to purchase price
  • Non-refundable
  • Ten business days from date of sale to arrange financing and pay balance in full at Superior Court of Justice, 333 Church Street, Fort Frances, Ontario P9A 1C9
  • All payments in cash or by certified cheque made payable to the Minister of Finance.
  • Deed Poll provided by Sheriff only upon satisfactory payment in full of purchase price.
