Notice of Default in Complying with the Corporations Tax Act

The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

Notice Is Hereby Given under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. All enquiries concerning this notice are to be directed to Ministry of Finance, Corporations Tax, 33 King Street West, Oshawa, Ontario L1H 8H6.

Cancellation of Certificate of Incorporation (Corporations Tax Act Defaulters)

Notice Is Hereby Given that, under subsection 241(4) of the Business Corporations Act, the Certificate of Incorporation of the corporations named hereunder have been cancelled by an Order for default in complying with the provisions of the Corporations Tax Act, and the said corporations have been dissolved on that date.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and concurrence of the Executive Council, orders that:

O.C./Décret 1941/2012

Order in Council

Whereas pursuant to subsection 118(2) of the Public Transportation and Highway Improvement Act, R.S.O 1990, c. P. 50 (the “Pthia”), the Minister of Transportation may, out of money appropriated therefor by the Legislature and upon such conditions as the Minister considers advisable, provide grants, loans and other financial assistance to any person for specific projects that the Minister considers to be of provincial significance;

And Whereas, since 2010 and pursuant to subsection 118(2) of the Pthia, the Minister of Transportation has been providing, grants to encourage the purchase of certain battery electric vehicles and plug-in hybrid electric vehicles by means of the Electric Vehicle Incentive Program (“EVIP ”), subject to such conditions as the Minister of Transportation may determine, and pursuant to Order in Council O.C. 955/2010 dated June 23, 2010 and published in The Ontario Gazette on July 10, 2010, the Minister of Revenue and subsequently the Minister of Finance have administered certain aspects of the EVIP ;

And Whereas, pursuant to subsection 118(2) of the Pthia, the Minister of Transportation intends to provide grants to encourage the purchase of certain electric vehicle charging stations by means of an Electric Vehicle Charging Incentive Program (“EVCIP ”), subject to such conditions as the Minister of Transportation may determine;

And Whereas it would be expedient for the Minister of Finance to continue to administer certain aspect of the EVIP , and to administer certain aspects of the EVCIP ;

And Whereas subsection 2(2) of the Executive Council Act, R.S.O 1990, c. E. 25 provides that the Lieutenant Governor may, by Order in Council, prescribe the duties of the ministers of the Crown and the duties of any ministries over which they preside;

And Whereas subsection 5(1) of the Executive Council Act provides that any of the powers and duties that have been assigned by law to any minister of the Crown may from time to time, by Order in Council, be assigned and transferred for a limited period or otherwise to any other minister by name or otherwise;

And Whereas subsection 8(1) of the Executive Council Act provides that the authority of the Lieutenant Governor under that Act includes authority to direct that two or more ministers share a power, duty, function or responsibility under an Act and that such authority also includes authority to direct how the ministers are to share such a power, duty, function or responsibility;

Therefore, pursuant to subsections 2(2), 5(1) and 8(1) of the Executive Council Act, despite any provision of a statute or Order in Council, the powers, duties, functions and responsibilities of the Minister of Transportation in respect of subsection 118(2) of the Pthia are hereby shared between the Minister of Transportation and the Minister of Finance in respect of the EVIP and EVCIP , with the Minister of Transportation being responsible for the programs generally and determining the conditions upon which EVIP and EVCIP grants may be issued, and with the Minister of Finance being responsible for receiving applications and verifying eligibility for EVIP and EVCIP grants;

And Therefore, pursuant to subsections 2(2) and 8(1) and section 10 of the Executive Council Act, despite any provision of a statute or Order in Council, the functions and responsibilities of the Ministry of Transportation and the Ministry of Finance, and of their respective public servants, are hereby shared consistent with the foregoing paragraph;

Further, Order in Council O.C. 955/2010 dated June 23, 2010 and published in The Ontario Gazette on July 10, 2010 is hereby revoked effective the date of this Order;

And Order in Council O.C. 1702/2003 dated November 19, 2003 and published in The Ontario Gazette on January 10, 2004 and Order in Council O.C 1568/2011 dated December 7, 2011 and published in The Ontario Gazette on December 17, 2011 are hereby amended and shall be interpreted accordingly.
