Government Notices Respecting Corporations

Notice of Default in Complying with the Corporations Tax Act

The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

Notice Is Hereby Given under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. All enquiries concerning this notice are to be directed to Ministry of Finance, Corporations Tax, 33 King Street West, Oshawa, Ontario L1H 8H6.

Cancellation of Certificate of Incorporation (Corporations Tax Act Defaulters)

Notice Is Hereby Given that, under subsection 241(4) of the Business Corporations Act, the Certificate of Incorporation of the corporations named hereunder have been cancelled by an Order for default in complying with the provisions of the Corporations Tax Act, and the said corporations have been dissolved on that date.

Order Made Under The Municipal Act, 2001, S.O. 2001, C.25

County Of Huron

Town Of Goderich, Municipality Of Central Huron

Definitions

1. In this Order,
   
   “Central Huron” means The Corporation of the Municipality of Central Huron;
   
   “County” means The Corporation of the County of Huron; and
   
   “Goderich” means The Corporation of the Town of Goderich.

Annexation

2. 1. On January 1, 2014, the area described in the Schedule is annexed to Goderich.
   2. Subject to subsection (3), all real property of Central Huron including any highway, street fixture, waterline, easement and restrictive covenant running with the annexed land vests in Goderich on January 1, 2014.
   3. All assets and liabilities of Central Huron or the County that are located in the annexed area remain the assets and liabilities of Central Huron or the County, respectively.

Assessment

3. For the purpose of the assessment roll to be prepared for Goderich for taxation in the year that the annexation under section 2 takes effect, the annexed area shall be deemed to be part of Goderich and the annexed area shall be assessed on the same basis that the assessment roll for Goderich is prepared.

Taxes, Etc

4. 1. All real property taxes, special rates or charges levied under any general or special Act in the annexed area which are due and unpaid on December 31, 2013, shall be deemed on January 1, 2014 to be taxes due and payable to Goderich and may be collected by Goderich.
   2. The clerk of Central Huron shall prepare and furnish forthwith to the clerk of Goderich, in respect of the annexed area, a special collector’s roll showing all arrears of real property taxes or special rates assessed against the land in the annexed area up to January 1, 2014 and the persons assessed for them.
   3. Within 30 days after the real property taxes or special rates are collected under subsection (1), Goderich shall pay to Central Huron an amount equal to the amount collected by Goderich.
   4. If Central Huron has commenced tax sales procedures under the Municipal Act, 2001 for land in the annexed area and the procedures are not completed by January 1, 2014, Goderich may continue the procedures.

Municipal By-Laws

5. 1. On January 1, 2014, the following by-laws of Central Huron are deemed to be by-laws of Goderich and shall remain in force in the annexed area until they expire or are repealed or amended to provide otherwise:
      1. by-laws passed under section 34 or 41 of the Planning Act or a predecessor of those sections;
      2. by-laws passed under the Highway Traffic Act or the Municipal Act, 2001 or a predecessor of those Acts to regulate the use of highways by vehicles and pedestrians and to regulate the encroachment or projection of buildings upon or over highways;
      3. by-laws passed under sections 45, 58 or 61 of the Drainage Act, or a predecessor of those sections; and
      4. by-laws conferring rights, privileges, franchises, immunities or exemptions that could not have been lawfully repealed by Central Huron.
   2. The official plan of Central Huron as it applies to the annexed area in the Schedule, and as approved under the Planning Act or a predecessor of that Act, becomes an official plan of Goderich and shall remain in force until revoked or amended to provide otherwise.
   3. If Central Huron has commenced procedures to enact a by-law under any Act or to adopt an official plan or an amendment thereto under the Planning Act and that by-law, official plan or amendment applies to the annexed area and is not in force on January 1, 2014, Goderich may continue the procedures to enact the by-law or adopt the official plan or amendment to the extent that it applies to the annexed area.

Dispute Resolution

6. 1. If a dispute arises with respect to any issue arising out of the interpretation of this Order, any of the municipalities may refer the matter in dispute for resolution through mediation. The mediator shall be agreed upon by all parties.
   2. If the dispute is not resolved through mediation or the parties cannot agree upon the selection of a mediator, then the matter may be referred to arbitration, to be conducted in accordance with the provisions of the Arbitration Act, 1991, except as provided herein.
   3. The costs associated with the mediation or arbitration proceedings shall be shared equally between the municipalities.

Schedule

Description of the lands to be annexed to The Corporation of the Town of Goderich:

Firstly:
All of Lot 3, Concession 1, Geographic Township of Goderich (including the portion also known as Lot 3, Broken Front Concession), save and except the east 17 feet of the east limit of Lot 3, from the northerly limit to the southerly limit of the Lot, being the portion taken for highway widening on Deposited Plan 1206 and designated as Highway No. 21 as shown on Deposited Plan 2187;

Secondly:
Part of Lots 1 and 2 and Part of the Old Railway Property, and all of Lots 6, 7, 21, 22, 23, 24, 25 and 26 on Registered Plan 2 (538), being part 2 on Reference Plan 22R-670;

Thirdly:
All of the Unnamed Road on Registered Plan 2 (538), known as Dechert Road, save and except that portion being the east 17 feet as shown on Deposited Plan No. 2187 and designated as Highway No. 21;

Fourthly:
Part of the Road Allowance on Registered Plan 2 (538), being Part 6 on Reference Plan 22R-670;

Fifthly:
All of Lots 18, 19 and 20 on Registered Plan 2 (538), being Part 10 on Reference Plan 22R-670;

Sixthly:
Part of Lot 12 on Registered Plan 2 (538), being Part 1 on Reference Plan 22R-2778.

Provincial Land Tax Act

Take Notice that I have caused a list of the lands, in respect of which notices have been mailed under subsection 1 of Section 15 of The Provincial Land Tax Act, 2006, to be prepared and to be published herein, and I hereby Give Notice that unless the total amount of tax, penalties, interest and costs shown in any of the notices so mailed are paid on or before the 30^th day of November, 2014, the land and every interest therein in respect of any such notice will be liable to be forfeited to and to be vested in the Crown on the 1^st day of December, 2014 by certificate of The Deputy Minister under his hand and seal of office.
