Under And By Virtue Of a Writ of Seizure and Sale issued out of the Federal Court at Ottawa, On dated January 7, 2010, Court File Number ITA-7203-05, to me directed, against the real and personal property of Romulus Fundeanu, Defendant(s), at the suit of The Minister Of National Revenue, Plaintiff(s), I have seized and taken in execution all the right, title, interest and equity of redemption of Romulus Fundeanu, Defendant(s) in and to:

Lt 40, PL 1179, Hamilton, the property municipally known as 20 Holbrook Road, Hamilton, On.

All of which said right, title, interest and equity of redemption of Romulus Fundeanu, Defendant(s), in the said lands and tenements described above was offered by public auction on March 25, 2015 was aborted. I shall again offer for sale by a sealed bid Auction subject to the terms and conditions set out below.

Bid Process:

Signed bids must be submitted in a complete and clear manner and must be accompanied by a deposit in the form of a money order, bank draft or a cheque certified by a bank or trust corporation payable to the Minister of Finance.

Signed bids must be enclosed in a sealed envelope labelled “Sheriff’s Sale, 20 Holbrook Road, Hamilton”

Signed bids must clearly and legibly include the following:

  • Amount of bid
  • The address of the property of which the right, title, interest and equity of redemption is being sold. The address being 20 Holbrook Road, Hamilton, Ontario
  • Name and address of the proposed purchaser
  • Daytime phone numbers of the proposed purchaser or authorized agent

Bids must be received by the Sheriff at the John Sopinka Court House, 45 Main St, East, Hamilton, ON L8N 2B7 no later than 3:00 p.m. local time on Friday, March 4, 2016.

Bids received after 3:00 p.m. on Friday, March 4, 2016 will not be considered.

Terms And Conditions:

The purchaser to assume responsibility for all mortgages, charges, liens, outstanding taxes, and other encumbrances. No representation is made regarding the title of the land or any other matter relating to the interest to be sold.

Vacant possession is not included in the sale of this property. Responsibility for ascertaining these matters rests with the potential purchaser(s).

The Sheriff may reject any or all bids that do not, in the Sheriff’s absolute discretion, reflect the fair market value of the equity of redemption of the lands and premises.

Terms:

Deposit 10% of bid price or $5,000.00, whichever is greater to be submitted with sealed bid

Deposit must be in the form of a certified cheque, bank draft or money order made payable to the Minister of Finance.

The deposit made by the successful bidder will be non-refundable and will be applied to the purchase price

The successful bidder will be notified within 5 days of closing of the auction, by mail and telephone to the address and telephone number provided on the successful bid.

The successful bidder will have ten (10) business days from the date notified, to pay the balance of the purchase price at the Courthouse.

All payments to be made in cash, certified cheque or bank draft made payable to the Minister of Finance

The Sheriff will provide a Deed Poll only upon satisfactory payment in full of purchase price.

Deposit to be returned to the unsuccessful bidders, 10 business days after the bids are opened, by mail to the address provided by the unsuccessful bidders.

This Sale Is Subject To Cancellation By The Sheriff Without Further Notice Up To The Time Of Sale.

Note: No employee of the Ministry of the Attorney General may purchase any goods or chattels, lands or tenements exposed for sale by a Sheriff under legal process, either directly or indirectly.
