Notice of Amendments to the Standard Supply Service Code

The following amendments to the Standard Supply Service Code, made on December 14, 2022, came into effect on January 1, 2023:

  1. Section 1.1.2 is amended as follows:
    1. The word “three” is deleted and replaced with the word “four”.
    2. In paragraph (b), the words “the Board’s regulated price plan contemplated in section 79.16 of the Act” are deleted and replaced with the words “tiered pricing”.
    3. The word “and” at the end of paragraph (b) is deleted.
    4. In paragraph (c), the words “the Board’s regulated price plan contemplated in section 79.16 of the Act” are deleted and replaced with the words “standard time-of-use pricing”.
    5. In paragraph (c), the period at the end of the sentence is deleted and replaced with a semicolon followed by the word “and”.
    6. The following paragraph is added immediately after paragraph (c):

      (d) ultra-low overnight time-of-use pricing for RPP consumers with eligible time-of-use meters who have elected to be charged on the basis of this regulated price plan in accordance with section 3.5 (section 3.4A).

  2. The definition of “eligible low-income customer” in section 1.2.1 is amended by replacing the period at the end of the sentence with a semi-colon.
  3. The definition of “eligible time-of-use meter” in section 1.2.1 is amended by replacing the word “section” with the word “sections” and inserting the words “and 3.4A.1” immediately after “3.4.1”.
  4. The definition of “RPP consumer” in section 1.2.1 is amended by replacing the word “or” immediately after “3.3” with a comma and inserting the phrase “or 3.4A” immediately after “3.4”.
  5. The following section is added immediately after section 1.6.7:

    1.6.8 The amendments to sections 1.1, 1.2, 1.7, 3.1, 3.2, 3.4, 3.5, 3.7, 3.8 and 3.9 made on December 14, 2022, and the addition of sections 3.4A and 3.4B, come into force on January 1, 2023.

  6. Section 1.7.3 is amended as follows:
    1. Paragraph (a) is deleted and replaced with the following:

      (a) the value of any of RPCMT1, RPCMT2, RPEMOFF, RPEMMID, RPEMON, ULONIGHT, ULOOFF, ULOMID or ULOON referred to in section 3.3, 3.4 or 3.4A;

    2. In paragraph (c), the words “or 3.4A.2(d)” are inserted immediately after “3.4.2(c)”.
  7. Paragraph 3.1.1(a) is amended by replacing the word “or” immediately after “3.3” with a comma and inserting the words “or 3.4A” immediately after “3.4”.
  8. Section 3.2.4 is amended by deleting the words “under section 79.4(2) of the Act”.
  9. Section 3.2.6 is amended by inserting the words “or 3.4A” immediately after “3.3”.
  10. Section 3.3.2 is amended as follows:
    1. In paragraph (c), the word “and” is inserted immediately after “October 31;”.
    2. In paragraph (d), the word “and” at the beginning of the paragraph is deleted.
  11. The heading of section 3.4 is amended by inserting the word “Standard” immediately before “Time-of-Use”.
  12. Section 3.4.2(d) is deleted and replaced with the following:

    (d) the hours of the day to which an off-peak, mid-peak and on-peak period apply shall be applied by a distributor on the basis of:

    1. central standard time or eastern standard time (as applicable to the distributor’s licensed service area); or
    2. daylight savings time,

    whichever is then prevailing in the Province of Ontario.

  13. The following sections are added immediately after section 3.4.3:

    3.4A Regulated Price Plan (Ultra-Low Overnight Time-of-Use Pricing)

    3.4A.1 The commodity prices for electricity payable by an RPP consumer that has an eligible time-of-use meter and has elected to be charged on the basis of this section in accordance with section 3.5 shall be:

    1. ULONIGHT/kilowatt hour for electricity used between 11:00 p.m. and 7:00 a.m. in any day of the year or, subject to the regulations, such other period as the Board may determine in accordance with the RPP Manual;
    2. ULOOFF/kilowatt hour for electricity used during a billing period during an off-peak period;
    3. ULOMID/per kilowatt hour for electricity used during a billing period during a mid-peak period; and
    4. ULOON/per kilowatt hour for electricity used during a billing period during an on-peak period.

    3.4A.2 For the purposes of section 3.4A.1:

    1. ULONIGHT (regulated price during overnight periods), ULOOFF (regulated price during off-peak periods), ULOMID (regulated price during mid-peak periods) and ULOON (regulated price during on-peak periods) shall be monetary values as set by the Board from time to time in accordance with the RPP Manual;
    2. ULOON shall be no lower than ULOMID; ULOMID shall be no lower than ULOOFF; and ULOOFF shall be no lower than ULONIGHT;
    3. each of the off-peak period, mid-peak period and on-peak period shall mean any period during a day, expressed as running from a specified hour to another specified hour, designated as such by the Board in accordance with the RPP Manual and which may be different for electricity use that occurs in the period May 1 to October 31 and for electricity use that occurs in the period November 1 to April 30; and
    4. the hours of the day to which an off-peak, mid-peak, on-peak and overnight period apply shall be applied by a distributor on the basis of:
      1. central standard time or eastern standard time (as applicable to the distributor’s licensed service area); or
      2. daylight savings time,

    whichever is then prevailing in the Province of Ontario.

    3.4A.3 On each bill submitted to an RPP consumer that is being charged the commodity price for electricity under section 3.4A.1, a distributor must show as separate items the volume of electricity billed at ULONIGHT, the volume of electricity billed at ULOOFF, the volume of electricity billed at ULOMID and the volume of electricity billed at ULOON. A distributor must also show, on the applicable separate line, the corresponding term “overnight”, “off-peak”, “mid-peak” or “on-peak”.

    3.4B Ultra-Low Overnight Time-of-Use Pricing: Transitional Matters

    3.4B.1 A distributor shall provide its eligible customers the option to elect under section 3.5 to be charged on the basis of ultra-low overnight time-of-use pricing for any billing period that begins on or after November 1, 2023.

    3.4B.2 A distributor may provide its eligible customers the option to elect under section 3.5 to be charged on the basis of ultra-low overnight time-of-use pricing for any billing period that begins on or after May 1, 2023.

    3.4B.3 Unless section 3.4B.2 applies, a distributor is not required to comply with section 3.5 in respect of ultra-low overnight time-of-use pricing until October 13, 2023. For greater certainty, in that case, the distributor is not required to apply a customer’s election to be charged on the basis of ultra-low overnight time-of-use pricing to a billing period that begins before November 1, 2023. Where section 3.4B.2 applies, a distributor shall comply with section 3.5 in respect of ultra-low overnight time-of-use pricing as of the date it begins providing its eligible customers the option to elect to be charged on the basis of that pricing plan.

    3.4B.4 For the purposes of this section 3.4B, an “eligible customer” is an RPP consumer with an eligible time-of-use meter.

  14. The heading of section 3.5 is amended by inserting the word “Standard” immediately before the phrase “Time-of-Use”.
  15. Section 3.5.1 is amended by inserting the words “or ultra-low overnight time-of-use prices under section 3.4A” immediately following “3.3” and inserting the word “standard” immediately before “time-of-use prices”.
  16. Section 3.5.4 is amended as follows:
    1. A comma followed by the words “or ultra-low overnight time-of-use prices under section 3.4A, as the case may be” are inserted immediately after “3.3”.
    2. In sub-paragraph (a)(ii), the words “or ultra-low overnight time-of-use prices, as the case may be,” are inserted immediately after “tiered prices”.
    3. In paragraph (b), the words “or ultra-low overnight time-of-use prices, as the case may be,” are inserted immediately after “tiered prices”, and the semicolon at the end of the paragraph is deleted.
    4. The words “provided, however, that no election shall be applied to a billing period that begins before November 1, 2020” are deleted.
  17. Section 3.5.5 is amended as follows:
    1. A comma followed by the words “or ultra-low overnight time-of-use prices under section 3.4A, as the case may be” are inserted immediately following “3.3”.
    2. In paragraph (a), the words “or ultra-low overnight time-of-use prices, as the case may be” are inserted immediately after “prices”.
  18. Section 3.5.8 is amended as follows:
    1. In the first sentence, the words “tiered prices under section 3.3 or time-of-use prices under section 3.4” are deleted and replaced with the words “tiered prices under section 3.3, standard time-of-use prices under section 3.4 or ultra-low overnight time-of-use prices under section 3.4A”, and the words “charging prices under section 3.3 or 3.4” are deleted and replaced with the words “charging prices under section 3.3, 3.4 or 3.4A”.
    2. In the second sentence, a comma followed by the words “ultra-low overnight time-of-use prices” are inserted immediately after “tiered prices”, and the word “standard” is inserted immediately before “time-of-use prices”.
    3. In the third sentence, the word “standard” is inserted immediately before “time-of-use prices”.
  19. Section 3.5.9 is amended as follows:
    1. The word “or” immediately following “3.3” is replaced with a comma followed by the word “standard”.
    2. The words “or ultra-low overnight time-of-use prices under section 3.4A” are inserted immediately following “3.4”.
    3. The words “or ultra-low overnight time-of-use prices” are inserted immediately following “If the consumer elects to be charged tiered prices” and “if the consumer does not elect to be charged tiered prices”.
    4. The word “standard” is inserted immediately before “time-of-use prices at the time of reassignment”.
  20. Section 3.5.10 is amended as follows:
    1. The words “or ultra-low overnight time-of-use prices under section 3.4A” are inserted immediately following “3.3”.
    2. The words “be charged time of use” are deleted and replaced with the words “switch to the other price plan or to standard time-of-use”.
  21. Section 3.5.11 is amended by replacing the word “or” following “3.3” with a comma and inserting “or 3.4A” at the end of the sentence.
  22. Section 3.5.12 is amended by inserting the words “or ultra-low overnight time-of-use prices under section 3.4A” immediately following “3.3” and inserting the word “standard” immediately following the word “than”.
  23. Section 3.7.1 of the SSSC is amended as follows:
    1. In each of paragraphs (a), (b) and (c), the word “or” immediately following “3.3” is deleted and replaced with a comma and the words “or 3.4A” are inserted immediately following “3.4”.
  24. Section 3.7.2 is amended by replacing the word “or” immediately following “3.3.5” with a comma and inserting the words “or 3.4A.3” immediately following “3.4.3”.
  25. Section 3.8.1 is amended as follows:
    1. In paragraph (a), the word “or” immediately before “RPEMON” is deleted, and a comma followed by the words “ULONIGHT, ULOOFF, ULOMID, or ULOON” are inserted immediately following “RPEMON”.
    2. In paragraph (a), the word “or” immediately after “3.3” is deleted and replaced with a comma, and the words “or 3.4A” are inserted at the end of the paragraph.
    3. Paragraph 3.8.1(c) is amended by inserting “or 3.4A.2(d)” at the end of the paragraph.
  26. Section 3.9 is amended by deleting the word “or” immediately following “3.3” and replacing it with a comma and inserting the words “or 3.4A” immediately following “3.4”.
