OSC Rule 11-502 Distribution of Amounts Received by the OSC Under Disgorgement Orders and Payment of Related Administrative Costs and OSC Rule 11- 503 (Commodity Futures Act) Distribution of Amounts Received by the OSC Under Disgorgement Orders and Payment of Related Administrative Costs
On September 1, 2025 (the Effective Date), the following rules came into force:
- OSC Rule 11-502 Distribution of Amounts Received by the OSC under Disgorgement Orders and Payment of Related Administrative Costs; and
- OSC Rule 11-503 (Commodity Futures Act) Distribution of Amounts Received by the OSC under Disgorgement Orders and Payment of Related Administrative Costs (together, the Rules).
In connection with the Rules, the Ontario Securities Commission (OSC) also adopted:
- Companion Policy 11-502 Distribution of Amounts Received by the OSC under Disgorgement Orders and Payment of Related Administrative Costs; and
- Companion Policy 11-503 (Commodity Futures Act) Distribution of Amounts Received by the OSC under Disgorgement Orders and Payment of Related Administrative Costs (together, the Companion Policies).
The Rules establish the process to distribute money received by the OSC under disgorgement orders to harmed investors. This process is intended to be streamlined, transparent, and efficient, and is designed to support better and timelier investor redress.
