Order Made Under the Municipal Act, 2001, S.O. 2001, c. 25 Town of Hanover, Municipality of West Grey County of Grey
Definitions
In this Order,
“annexed area” means the area comprised of the lands described in the Schedule to this Order;
“Grey County” means the Corporation of the County of Grey;
“Hanover” means The Corporation of the Town of Hanover; and
“West Grey” means The Corporation of the Municipality of West Grey.
Annexation
- On May 1, 2026, the area described in the Schedule is annexed to Hanover.
- All real property of West Grey, including but not limited to any highway, fixture, easement and restrictive covenant running with the land, located in the annexed area, vests in Hanover on May 1, 2026.
- Despite subsection (2), all other assets and liabilities of West Grey or Grey County that are located in the annexed area remain the assets and liabilities of West Grey or Grey County, as the case may be.
- Despite subsection (3), any reserve fund, trust fund, or other account of any nature, or any portion thereof, held by West Grey on May 1, 2026, which is held for the sole purpose of maintenance, improvement or operation of any of the real property referenced in subsection (2), shall be transferred to Hanover on May 1, 2026.
- Despite subsection (2), any litigation commenced prior to May 1, 2026, with respect to the annexed area remains the obligation of West Grey or Grey County, as the case may be, unless otherwise agreed to by the affected municipalities in writing.
Taxes and Assessment
- All real property taxes, special rates or charges levied under any general or special Act in the annexed area which are due and unpaid on May 1, 2026, shall be deemed on May 1, 2026, to be taxes due and payable to Hanover and may be collected by Hanover.
- On or before May 1, 2026, the Treasurer/Collector of West Grey shall prepare and furnish to the Treasurer of Hanover, in respect of the annexed area, a special collector’s roll showing all arrears of real property taxes, special rates or charges assessed against the land in the annexed area up to and including May 1, 2026, and the persons assessed for them.
- Should Hanover recover all or a portion of the arrears set out in the special collector’s roll described in subsection (2), within ninety days of receiving such funds, Hanover shall pay to West Grey the total amount of any outstanding arrears, exclusive of costs, penalties and interest charges, accrued to May 1, 2026, in respect of the annexed area, and thereafter any arrears and penalties collected by Hanover in respect of the annexed area shall accrue to Hanover.
- For the purpose of the assessment roll to be prepared for Hanover for taxation in the part of the year that the annexation under section 2 takes effect, the annexed area shall be deemed to be part of Hanover, and the annexed area shall be assessed on the same basis that the assessment roll for Hanover is prepared.
- If West Grey has commenced tax sales procedures under the Municipal Act, 2001 for land within the annexed area and the procedures are not completed by May 1, 2026, Hanover may continue the procedures for the benefit of Hanover.
- Hanover shall provide a tax credit for the taxes levied for the purpose of the general local municipality levy to any property within the annexed area that is subject to a higher tax rate for municipal purposes solely as a result of this Order between May 1, 2026 and May 1, 2030. The amount of this credit shall be determined by calculating the difference between the applicable property tax rate of Hanover and the property tax rate of West Grey that would have been applicable but for this Order, for the 2026 taxation year, and applying this difference to the assessed value of the property. The tax credit shall be equal to 80% of the tax difference in 2026 and phased out over a period of four years between May 1, 2026 and May 1, 2030 by reducing the amount of the tax credit by 20% of the original amount in each year.
- Despite subsection (6), if any of the following events occurs in respect of a property or any portion of a property in the annexed area, the tax credit or any portion of the tax credit shall cease to be applied:
- There is a change in ownership of a property between May 1, 2026, and May 1, 2030], except between spouses, or, in the case of agricultural lands, as between parent and child, where the transfer is for the purposes of succession planning. For purposes of this section, “child” means a child born within or outside marriage and includes an adopted child and a person whom a parent has demonstrated a settled intention to treat as a child of his or her family;
- There is a change in the use of the property, including:
- An official plan amendment, that applies to some or all of the property, adopted in response to a request made under section 22 of the Planning Act comes into effect;
- An amendment to a zoning by-law, that applies to some or all of the property, passed in response to an application under section 34 of the Planning Act comes into force;
- Plans and drawings for development, that apply to some or all of the property, within a designated site plan control area under section 41 of the Planning Act have been approved;
- A final plan of subdivision, for some or all of the property, under section 51 of the Planning Act is deposited with the land registrar for registration;
- Consent has been given under section 53 of the Planning Act in respect of a transaction related to the property; or
- There is a change in classification of a property under the Assessment Act;
Municipal By-laws and Official Plans
- On May 1, 2026, the by-laws of Hanover extend to the annexed area and shall remain in force in the annexed area until they expire or are repealed or amended to provide otherwise.
- Despite subsection (1), on May 1, 2026, the following by-laws of West Grey are deemed to be by-laws of Hanover and remain in force in the annexed area until they expire or are repealed or amended to provide otherwise:
- by-laws passed under section 34 or 41 of the Planning Act or a predecessor of those sections;
- by-laws passed under the Development Charges Act, 1997 or a predecessor of that Act;
- by-laws passed under the Highway Traffic Act or the Municipal Act, 2001 or a predecessor of those Acts that establish highways, regulate the use of highways by vehicles and pedestrians, or that regulate the encroachment or projection of buildings upon or over highways;
- by-laws passed under sections 45, 58 or 61 of the Drainage Act or a predecessor of those sections;
- by-laws conferring rights, privileges, franchises, immunities or exemptions that could not have been lawfully repealed by West Grey.
- The official plan of West Grey as it applies to the annexed area, and as approved under the Planning Act or a predecessor of that Act, becomes an official plan of Hanover and shall remain in force until revoked or amended to provide otherwise.
- If West Grey has commenced procedures to enact a by-law or adopt an official plan or an amendment thereto under any Act and that by-law, official plan or amendment applies to the annexed area and is not in force on May 1, 2026, Hanover may continue the procedures to enact the by-law or adopt the official plan or amendment to the extent that it applies to the annexed area.
Dispute Resolution
- If a dispute arises with respect to any issue arising out of the interpretation of this Order, any of the municipalities may refer the matter in dispute for resolution through mediation. The mediator shall be agreed upon by all parties.
- If the dispute is not resolved through mediation or the parties cannot agree upon the selection of a mediator, then the matter may be referred to arbitration, to be conducted in accordance with the provisions of the Arbitration Act, 1991, except as provided herein.
- Where a dispute is referred to arbitration under subsection (2), the decision of the arbitrator shall be final.
- The costs of the mediation under subsection (1) or arbitration proceedings under subsection (2) shall be shared equally between the parties that required the mediation or arbitration proceedings.

Description of the Annexed Area
The portion of the Township of Bentinck, Municipality of West Grey, County of Grey is described as follows:
Part 1:
- Those portions of lands located in the Geographic Township of Bentinck, Municipality of West Grey, County of Grey, being more particularly described as:
- All of Lots 1-10 Concession 3, North of the Durham Road, lying East of Bruce Road 10 and West of the 5th Sideroad North of the Durham Road along the northern limit of Grey Road 28. Said lands being all of the lands as identified by the following Property Identification Numbers and all registered in the Land Registry Office for the Land Titles Division of Grey (No. 16):

Those portions of lands forming Part of Lots 16-19 Concession 1 North of the Durham Road, in the Geographic Township of Bentinck, said lands being further described in registered instrument R397026 as follows:
(1) Being the fourthly described lands consisting of Part of Lot 16 Concession 1 North of the Durham Road, in the Geographic Township of Bentinck, more particularly described as follows:
- commencing at a point in the westerly limit of said Lot 16 a distance of 275.22 feet northerly from the southwest corner of Lot 16 Concession 1 North of the Durham Road;
- thence North along the westerly limit of Lot 16 to the northwesterly angle of Lot 16;

Whereas subsection 2(2) of the Executive Council Act provides that the Lieutenant Governor may by order in council prescribe the duties of the ministers of the Crown and the duties of any ministries over which they preside;
And whereas subsection 5(1) of the Executive Council Act provides that any of the powers and duties that have been assigned by law to any minister of the Crown may from time to time by order in council be assigned and transferred for a limited period or otherwise to any other minister by name or otherwise;
And whereas subsection 8(1) of the Executive Council Act provides that the authority of the Lieutenant Governor under this Act to prescribe duties of a minister of the Crown or to assign and transfer powers and duties that have been assigned by law to a minister of the Crown to any other minister includes authority, by order in council, to assign responsibility for the administration of an Act or a part of an Act to a minister of the Crown;
Therefore, pursuant to subsections 2(2), 5(1) and 8(1) of the Executive Council Act, despite any provision of a statute or Order in Council:
Each Order in Council cited in Column 4 of Schedule 1 to this Order in Council is amended such that the administration of each statute listed in Column 2 of the Schedule is assigned to the Minister or Ministers listed opposite that statute in Column 3 of the Schedule.
