On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas pursuant to subsection 10(2) of the Liquor Control Board of Ontario Act, 2019, the Liquor Control Board of Ontario (the “LCBO”) may, subject to the approval of the Lieutenant Governor in Council, establish job categories, salary ranges and conditions of employment for its employees;

And whereas pursuant to Order in Council 1066/2021 dated July 29, 2021, the LCBO revised the salary ranges and conditions of employment for employees (the “Unionized Employees”) represented by the Ontario Public Service Employees Union, Liquor Board Employees Division (the “Union”) pursuant to a Memorandum of Settlement between the LCBO and the Union which was subject to a wage re-opener in the event that Bill 124, Protecting a Sustainable Public Sector for Future Generations Act, 2019 (“PSPSFGA”) be found unconstitutional by a court of competent jurisdiction prior to the March 31, 2024 expiry of the Collective Agreement (“Collective Agreement”);

And whereas the Court of Appeal for Ontario declared the PSPSFGA unconstitutional with respect to represented employees in a decision dated February 12, 2024 (“Decision”);

And whereas the LCBO and the Union entered binding arbitration in respect of wages as a result of the Decision and received an arbitral award on March 10, 2024 providing for wage increases for Unionized Employees (“Award”);

And whereas the Collective Agreement has expired, and the LCBO and the Union have negotiated a new collective agreement subject to approval by the Lieutenant Governor in Council under s. 10(2) of the Liquor Control Board of Ontario Act, 2019 (“Minutes of Settlement”);

And whereas the LCBO is seeking the approval of the Lieutenant Governor in Council to reestablish the salary ranges in accordance with the attached Award, and establish revised job categories, salary ranges and conditions of employment in accordance with the attached Minutes of Settlement;

Therefore:

  1. Pursuant to subsection 10(2) of the Liquor Control Board of Ontario Act, 2019, the salary ranges for the Unionized Employees reestablished in accordance with the attached Award are hereby approved.
  2. Pursuant to subsection 10(2) of the Liquor Control Board of Ontario Act, 2019, the job categories, salary ranges and conditions of employment established in accordance with the attached Minutes of Settlement are hereby approved.
