On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas pursuant to Order in Council 1198/2022 the Minister of Infrastructure (the “Minister”) is responsible for the administration of the Ministry of Infrastructure Act, 2011 (the “Act”);

And whereas pursuant to subsection 10(2) of the Act, the Minister, on the direction of the Lieutenant Governor in Council, for and in the name of the Crown, shall, without consent of the owner, enter on, take and expropriate any land or interest in land that the Lieutenant Governor in Council considers necessary for the benefit of the public;

And whereas all of the properties described in Schedule “A” attached hereto (the “Lands”) are required for:

  1. The construction of the subway line known as the Ontario Line and ancillary works;
  2. The construction of the station known as the East Harbour SmartTrack station and ancillary works;
  3. The construction of the extension of Broadview Avenue in the City of Toronto;
  4. The development of a transit-oriented community known as the East Harbour Transit-Oriented Community Project.
  5. The construction of the Broadview and Eastern Avenue Flood Protection Project and ancillary works.

And whereas the Lieutenant Governor in Council considers the expropriation of the Lands to be necessary for the completion of the projects described in the preceding paragraph (collectively “the Projects”);

And whereas the Lieutenant Governor in Council considers the completion of the Projects to be a benefit to the public;

Therefore, pursuant to subsection 10(2) of the Act, in view of the public benefit that necessitates the expropriation of these Lands, the Lieutenant Governor in Council hereby directs the Minister to, without consent of the owner, enter on, take, and expropriate those properties described in the attached Schedule “A”, effective the date of this Order as may be required for the Projects.
