On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Lieutenant Governor in Council has appointed a person to serve as Secretary of the Cabinet and has appointed other persons to serve as deputy ministers in the Public Service of Ontario pursuant to various Acts of the Legislature relating to the Ministries of the Government of Ontario and to the prerogative of His Majesty the King in Right of Ontario to appoint persons to serve his Majesty’s Government of Ontario;

And whereas the Lieutenant Governor in Council finds it necessary and advisable to revise remuneration for deputy ministers;

Now therefore, pursuant to the authorities cited above:

Effective the date of this Order in Council, Order in Council O.C. 1374/2019 dated September 26, 2019, as amended by Order in Council O.C. 481/2024 dated March 28, 2024, is further amended as follows:

  1. By adding the following sentence at the end of paragraph 7)

    Effective for the April 1, 2023 to March 31, 2024 and thereafter, despite foregoing, the Secretary of the Cabinet may exercise discretion to adjust the individual and/or ministry rating of a Deputy Minister for the purposes of determining the applicable percentage of pay for performance for any given performance cycle, on the condition that the discretion cannot be applied to more than 5% of executives in the Ontario Public Service. For the purpose of this provision, “executives” means public servants appointed by the Public Service Commission in the following executive and management classes of position: Executive 2, 3 and 4, OPP1 and OPP2, Management Crown Counsel 5B, C and D and deputy ministers.

  2. by adding the following provision:
    Secretary of the Cabinet Exceptional Award

    7.1) Effective for the April 1, 2023 to March 31, 2024 performance cycle and thereafter, Deputy Ministers who received an Outstanding individual performance rating in relation to the completed performance cycle shall be eligible to receive the Secretary of the Cabinet’s Exceptional Award which recognizes the significant individual achievement, in an amount of up to three per cent of the public servant’s annual base salary, to be determined in a manner consistent with the rules applicable to public servants appointed to Executive 2, 3 and 4 classes of position in the Ontario Public Service on the condition that the exceptional award cannot be provided to more than 1% of executives in the Ontario Public Service. For the purpose of this provision, “executives” means public servants appointed by the Public Service Commission in the following executive and management classes of position: Executive 2, 3 and 4, OPP1 and OPP2, Management Crown Counsel 5B, C and D and deputy ministers.
